Of course it is.

No different than.... well, not gonna dig up any examples, but if Apple says it is available on xx date, then it is available on xx date. When you bought it, you agreed to it.

If you and Apple had agreed on an earlier date, then UPS would have a problem.

I didn't agree to anything. I was not told a date when I would receive it, just it would be shipped via 'Standard Shipping'.

I apologize for the lack of updates.

TLDR: No, I did not end up getting it.

Long version: It said it was on it's way to be delivered. I was all excited, left my signed note, and headed off to school. I check it an hour later, and they said the note didn't meet requirements, and I could pick it up. I went to go pick it up, and the employee would not let me have it. I told him, it was attempted to be delivered today, hand it over. No dice. He said I had to wait like everyone else. I'm like, you have the box right in front of my eyes, would it kill you to hand it over? He said he did not have authority too.

Damn, I bet you wish you were home when they tried to deliver it.
 
I wouldn't count on it. Apple puts holds on everything.

The _only_ year that phones actually arrived just one day early was the release of iPhone 4. I know I was one of those whom AT&T delivered to the day before release.

Apple went ballistic and understandably so. Especially since mine (and hundreds of others) arrived at 9:50am which was a full day early.

Last year my iPhone 4S was held at the FedEx depot and delivered on the morning of release day :)

Not the only year, my 4S was a day early from FedEX last year. This year UPS is handling my shipment, still hopeful but doubtful. It's still in KY will probably be in AZ tomorrow morning after initial trucks are filled.

They went ballistic? I got an email from Apple telling me the phone would be a day early...
 
It'd be nice if I could get mine tomorrow but for selfish reasons. I have a personal trainer appointment Friday morning so I'm hoping it doesn't come before 9am :) Fedex usually comes here early though so we'll see.
 
That is where it would've helped to grease the wheels a little bit. If you offered to throw the guy some cash the box was right there. Nobody would've known.

You should of just called a friend and told them to make a diversion. The when he is not looking grab the phone. You paid 799 its yours not his.

What did you order that drove the cost up THAT high?? Even the AT&T with early upgrade for the top end phone only came to $650. Why did yours cost $799?
