My silence button is messed up. Will Apple replace my factory unlocked iPhone 3GS 16GB with a factory unlocked iPhone 4? Or can I buy a replacement iPhone 4 unlocked for 199?
 
Typically they only replace with like kind. Is your 3GS still under warranty? If so, you'll get a new 3GS if they choose to replace it.
 
That's like me going into Verizon and saying I want to replace my Droid X for a Droid X2. There's a reason you sign a contract...it's to force you to keep a phone for a specified amount of time or otherwise pay a lot of money to get out of it.

My former tennis coach had an iPhone 3GS which was apparently smashed by a hobo. He waited for weeks and finally called an Apple higher-up, and they gave him an iPhone 4.

If for some reason they do not have any iPhone 3Gs 16GB left, they may upgrade you in some way but I don't see you getting an iPhone 4 unless they're really hurting for stock.

No, you cannot pay the replacement fee and get an iPhone 4.

Does your silence button have the issue where when it's on silent mode, it constantly flickers between both profiles and it's constantly vibrating?

My 3GS has this issue.

But no, if they do replace it, it will be with the same model.

Saw a kid the other day try and "upgrade" his 3GS to an i4. Apple foresees this and is either still living off of previously produced but no longer sold 16Gb 3GS models or is still creating a small amount for warranty replacements.

Mine has this issue as well. I'm over 2 years now (though they did swap out the phone a year ago), so I figured there's no chance on getting this fixed. Anyone know?

And yeah, I don't see them upping to a 4...there are plenty of 3GSes available.

yeah it's that problem, guess it's common for 3gs

they may have 3gs lying around but how many are factory unlocked like mine?

They will just enter your new IMEI into their system to factory unlock it via iTunes I believe. It's not a hardware thing

Mine does this relentlessly. There's nothing more annoying than constantly reaching for your phone thinking you have a call or text only to find it's silent mode flickering on and off.

I completely turned off the vibrate option so now I don't feel the vibrations in my pocket, but my phone is constantly lighting up in my pocket whenever it thinks the switch is flipped.

I think I'm going to take it to Apple and see what they can do about it next time I'm in the area, but it's out of warranty so I'll just have to live with it. I'm trying to figure out how to make the switch control the rotation lock instead but that hasn't been going well. There's this app (Jailbroken) to let you switch profiles without the switch, so I may end up doing that.

Try disassembling the phone and removing the mute switch. It's attached to the headphone jack and power button but try removing the whole thing and reseating it. Could do the trick! It's plausible that you dropped it/damaged it some other way and the switch became unseated.
 
They're selling refurb 3Gs Iphones for $9 this month. What do you think they will give you?

Replacements are based off what is currently out and what is currently discontinue. Example if you had a 2007 macbook pro with applecare. You have some issues that are beyond repair you would be upgraded to the newest similar value spec at the time. But for now iPhones are not so limited nor dated. You will get what you currently have hope that helped.
