I think you should call and speak to the case supplier to see what they can suggest regarding this problem. Also set up a Facebook page to see it other people have been in the same position as you with this particular case. If they have then you can consult your findings together with your fellow sufferers and discuss the matter again with otterbox. We may see a class action lawsuit against the company coming.
 
Have you tried talking to otterbox? If the case caused the scuff, they should be responsible.

I don't believe it's possible, there was no damage to the plastic over the phone which was never removed, it had to have been there, people have been reporting the same thing. I could get it replaced, I just want to make sure Apple doesn't tell you it probably will be free and then tell you it's not once you send it away.

It's only an issue if you noticed it out of the box. If it wasn't there before the case was put it was caused by either you or the case.

I did not look out of the box but hurriedly put it in the case, the plastic never came off, there's no way.
 
Why should Apple give you a new phone if the case caused the damage? Apple sells you the phone without a case for a reason. It wouldnt be any different than you putting the phone in a case filled with battery acid.

Then you really don't know what caused it then. It's your duty as the buyer to look over your product to ensure it free of cosmetic damage before continuing to use it. At this point, I don't know what apple might do. I can't tell from the picture what might have caused it exactly because I don't know what the otterbox case for the iPhone looks like exactly. I've never seen first hang damage that was found out of the box so I don't know what those usually look like either (yes I've seen the photo's on here, but most of those are straight line scratches or nicks in the bezel).
