I understand this law, but I've always been frustrated by it, as I've always been told by both Apple Retail and Apple Online that they are two SEPARATE entities (which is why you can't always exchange online purchases at a retail store nor can you have orders shipped from Apple online to a retail store and pick it up).

So what are they, the same or different? If the same, why can't I do the same things with each store? If different, why am I subject to sales tax?

If what you were told is true, I would suspect that they are separate sub-entities, both owned by the same parent company, which would explain why they collect tax.

Either way, there is a huge difference between Apple charging tax (which they don't do, your state charges tax) and being required to collect tax. Besides non-taxable goods, you are legally supposed to submit tax for your purchase. The only difference is who submits the tax. If a company is required to collect the tax (not charge), then they submit it on your behalf. If a company is not required to collect tax (again, not charge), then you are legally supposed to submit the tax to your state.
 
This practice is ridiculous i don't want to pay taxes on this laptop. I rather buy it from a authorized retailer in my town and support the local economy but there is no free ipod deal, which ruins it.

I find it BS that you are a student in school and you have to pay sales tax. Its a joke. I have bought all of my macs, except for 1; from Amazon, eBay, or MacMall to avoid sales tax.

Don't forget that an item you don't pay sales tax on, you are supposed to report and pay as 'Use tax' (equivalent to the sales tax) ... State governments with Sales Tax always bemoan the fact that us 'tax cheats' are 'costing them' millions of dollars a year in unpaid Use Tax. :rolleyes:
 
If you want to baffle your brains any more, then try this.

In Tennessee, our sales tax is 9.25%. Apple? They charge 12%.

Yeah, thank goodness I've got family across the state line in Mississippi.

If you live in NJ (7% tax) and buy a computer (or anything else, usually popular with cars) and you move to VA (5% tax) technically you are owed a refund of the difference in tax. And if you move from VA to NJ you owe NJ the difference in tax. Works in other states.

Tax is usually built into the price if you don't see it as a line item, so you're really not getting away with much.
 
You always pay tax in the apple store but you get free shipping.

I am driving from new jersey to Atlanta for college and was planning on picking up a mbp iPod and printer in Delaware on the way in an apple store. I was under the impression that there is no tax in Delaware. Right? Not counting the whole I am supposed to pay later deal.

correct. delaware does not have a sales tax. i do the same thing for big purchases, just go to Delaware.

I've never paid taxxes on anything I've ever ordered online.

In fact the only place I've ever really been taxxed for a purchase is when I'm in MA.
