Not that I would spend money on such an app or on porn, but it does seem like there is a breach of trust here. Certainly it seems that one advantage of Apple approving iphone applications is that they can weed out scams. If they can't - or won't - then what does the App store do for the consumer other than limit choice? I've been thinking about buying an iphone, and it appeared that the app store was a benefit. However, if Apple is not going to stand by the products in the App store, then it just seems like a hook for a monopoly.

You'd think Apple would want to keep the good will of the punters, cough up the $2 refund, and then pursue the developer for damages for breach of contract.

A refund? $2. Consumer loyalty: priceless.

EDIT: Does anybody know what the consumer law is with regard to sales of software? Surely one must be entitled to a refund if the software fails to work as advertised.

Agreed, but what good is it if a product just stops working? That's when a warranty or return/exchange policy would go into effect. In this case, they're well on their way to losing an app store/itunes store customer to Amazon or another competitor

That's question begging. The issue is whether Apple *should* be able to disclaim any and all liability under these circumstances. Again, given the exclusivity of the app store, I don't think the argument in favor is at all clear cut. It seems to me Apple owes an extra duty of care to customers.
