I didnt think enough people actually messed with the beta's to have the servers get overloaded like this. You dont think this could be apples attempt at trying to lock us out of the new beta?

No, a LOT of people use the beta, developer or non-developer.

The amount of people on the iOS 7 Beta is probably larger than the amount of Android users on Jelly Bean.

No you can't. The betas expire after a week or so. After the beta is expired, the only way to update is to go to the dev site and download beta 2, then upgrade to beta 3. Better hurry before beta 2 expires!
 
I doubt its the servers. Wife just got home and her OTA worked flawlessly while mine still does not. Same house, same wifi, both iPhone 5's.
 
not sure whats up but i was having the same problems as you guys i restored back to ios 6 and updated to 1-2 and my OTA works fine now updating to beta 3 as we speak just letting you guys know
 
I think I found a solution, at least something that worked for me. If you have 4G, turn wifi off and go to software update. I was on 2 and with wifi it told me I was up to date, but if I'm on 4G it tells me I can update to Build 4. So I just turn on Wi-Fi from the control center and it works.
 
I'm having this same issue - iPhone 4S currently on iOS 7 (B3) and it just says I'm up to date. Tried it on a 3G connection, two different WiFi networks and I'm just stuck.

Try hard restarting the device and then reset all settings. That worked for me.

i had this issue on my ipad mini, but not on my iphone 4 that i was testing ios 7 on (beta 3). the iphone 4 detected the update OTA from 3 to 4 with no issue. the ipad mini on beta 3 wouldnt find the OTA, i had to update with the IPSW.
 
What does resetting all settings do - just moves settings to the default or messes with more personal things?

Just resets all settings, but it's a troubleshooting step used to solve problems. It does not delete any data.
