Because I can guaran-****-tee you you did NOT receive third degree burns from it[1]. This is not a bit sore and red, it's not even blisters and potentially a little bit of scarring, it's skin grafts and hospital time and massive scarring. Actually, I never drink tea very hot (sensitive mouth), and I don't drink coffee. But if I did, I would assume that I would occasionally heat the water too much.

Keep in mind that it can only go to 100˚C.

Being an American was grand many years ago, these days everything seems to be so corrupted. People have become shallow, materialistic, greedy, selfish, etc. and it's not getting any better.

Its not unreasonable to assume water needs to be boiled to make coffee or tea. So you must assume it will be very hot soon afterward.

Yes, I don't see how it can be overheated. The max is 100˚C before it turns into gas. Just assume it is about 100˚C since it was just boiled. McDonald's shouldn't have to pay because their water was too hot. There's no such thing.

having no limit to damages is one of the reasons that insurance is so high for hospitals etc and thus one of the main reasons it costs so much for anything at the doctors/hospitals. when a corporation is found guilty of negligence the corporation should pay all legal, medical bills and some punitive damages but not tens millions of dollars just for punitive. i know thats not what happened with the coffee case and from what ive read i am sympathetic to the coffee burn victim bc mcdonalds did not have the coffee hot but much hotter than it needed to be. and as with all docs take it with a big grain of salt. this is one of the few things that i agree with republicans.

How was it founded on that? It was founded by British making a colony that later became independent for various reasons including that Britain took advantage of them with tariffs.

About 5 years ago, I had a run in accident with small glass pane in my door (stupid cat). Long story short, I take a big chunk out of my finger (I've got a picture of it uploaded on my Dropbox. It's fun to show off at parties), and have to run to the emergency room. The doctor comes in, looks at it for roughly 40 seconds, and goes "EWW THAT'S GROSS! We can't stitch up a wound that size, so here some antibacterial cream and a roll of bandages. Hope you enjoy the awesome scar you're gonna have". Altogether, I think I spent 5 minutes with the doctor, and didn't get any form of medication I couldn't otherwise get off the counter at the local Walgreen's.

In total, that 5 minutes cost me $2000.

It's no wonder everyone is suing everyone these days. Even with insurance, it's the only way you can cover your medical bills without having to mortgage your house.

I know that. The water was near 100˚C (a bit lower). She should just assume it is close to 100˚C. I don't get why you're getting so upset about this.

McDonald's had the coffee hot enough to burn your tongue so people wouldn't realize how bad the coffee actually was. They were caught several times with having the water much too hot for consumption. This lady's lawsuit was used to make McDonald's stop.

People keep citing this case for why our system is broken when in reality it's McDonald's that perpetuated that myth to ensure people settle for almost nothing rather than take their chances in court and when what they deserve (at least medical expenses).

Yeah, my doctor charged $200 just to use some little thing I can probably get myself to see whether I have a bacterial or viral infection in my throat. It turned out to be viral, so he said just to let it go away.

If my parents weren't so careful, I'd probably be able to cure all of my injuries/sicknesses without a doctor using a little bit of knowledge I have from random sources and the internet.

That's very true. It's also a major reason why my RN wife doesn't want to go to back to school to become a Nurse Practitioner (they need malpractice insurance) even though the NP's at the hospital she works in want her to.

I know this isn't a horrible, horrible lawsuit, but you should just assume the coffee is around boiling point. So what if they make it extra hot so they can't tell the taste? It's irrelevant, you should just know that the hot water will burn you.

I got very lucky at school once. The hot water machine broke, making me upset because I had to eat my Cup o' Noodles cold (I rarely eat that junk). Soon after, someone smacked the table by mistake and made me spill the would-be-very-hot water all over myself. I would have been badly burned, but I would not have sued for that.

And no, consumable coffee that is sold isn't supposed to be at boiling point (coffee is horrid that way anyway).

Hey, I'd want my coffee served at boiling point almost. That way, I can keep it for a little before drinking it without it getting too cold. I'm assuming someone getting coffee to go wouldn't drink it immediately. There's nothing wrong with selling it extra hot.

But I do think McDonald's is evil for other reasons.
