Some of my real concern is that AT&T will actually charge me restocking fees or find some other way to totally screw me over on this and I'll regret trying to return it. I've never had good luck with them, only reason I stay with them is Verizon has zero coverage in my area.
 
The exact same thing happened to me about 7 years ago with the AT&T (I think it was Cingular at the time) and the Palm Treo. A key difference though is that I was only billed for one phone, not two. I seriously considered selling it on eBay (where I could've gotten $400+); instead, I just sent it back.
 
Ok, so I'm on AT&T and I ordered an iPhone 5, and two arrived separately, both in my name under my account. I was charged the $299 for both so it's not like I got it for free, just given the discount price. I have no sympathy for AT&T or Apple on this so my advice ask is not moral, but technical, what can I do? I don't care about the $300, but can this thing even be activated? Can I give it to my girlfriend who has a 4S on AT&T without issues? Or is it useless? Do I need a new SIM? Or should I have this thing unlocked and sell it?

Out of curiosity, why anyone have "sympathy for AT&T or Apple"?

I hear you. You didn't order it though, so it wouldn't be legal for them to charge you. Doesn't prevent them from trying. Honestly, a month ago I would've said differently. After having my first real issue with them, my opinion has changed for the worse.

2) That is a smaller price than an unsubsidized $749*1.06 = $794 phone

3) Technically what can he do with the maybe AT&T locked/maybe unlocked phone?

Keep it and enjoy it

He can get more than $600 on eBay, I'm seeing $700+ for AT&T or $800+ for unlocked.

Get an unlock code for $15 and profit.
 
I'm not a scumbag and I've given AT&T over $30,000 over the course of my contracts so they have made $29,900 in profit over the years.

Not sure if you were sarcastic or not, but if you are serious, that is as absurd as it gets. You think running the largest network in the world is making that profit margin. My guess s their margin is more like 3%, not 99%.

I most likely will return it which i am sure will probably result in a disastrous experience for me and one more reason to curse AT&T.
 
How do these folks sell new sealed iphones that are bought on another account. Dont they have o be activated first on he account they were bought on? My 4s was that was. Was nearly impossible to move to another number before activating.
