Glad I don't work in IP law.

It never ceases to amaze me how many blatant ripoffs are seen as 'good for competition' while other things get completely banned with the defendant giving all their money to the plaintiff.

I hate how it's applied to artistic endeavours because soooo many movies and pop songs are copies of each other.

Francesca Gregorini is also the stepdaughter of Beatles drummer Ringo Starr ... imagine that...

I've seen the film (mediocre with 40% Rotten Tomatoes) and with an exception of "baby is a doll", the series and the film are nothing alike.

The Truth About Emanuel

"A troubled young woman becomes obsessed with her mysterious new neighbor, who bears a striking resemblance to the girl's dead mother."

Servant

"A Philadelphia couple are in mourning after an unspeakable tragedy creates a rift in their marriage and opens the door for a mysterious force to enter their home."

Now I see the similarity.... both plots have the word "mysterious" and to sue Apple that's enough

Whatever happened to originality? It seems to be a lost art.

According to Christopher Booker, there are only seven basic plots...everything else is derivative.

I find Servant to be almost insufferably dull, not saved by acting or plot or visual drama, and in need of a few light bulbs. I can't conceive of a plot twist in the offing that would make this worthwhile going forward--devil, demon, alien baby, they're all dead, only some are dead, God is dead, cannibals, takes place on a vast interstellar craft, multiverse or whatever.

"substantially similar feeling, mood, and theme"

there's a finite number of movies that can have its own "feeling, mood, and theme."

This seems fairly shaky to me, especially since “The Boy” is another movie with a similar sounding plot too. I’m surprised how recent this film is and that it is has a fairly notable actress in it (Biel). Gives it a little more credibility possibility.

I've seen both the TV show and the movie in question and they not similar at all. They both involved people thinking a doll is real. That's all. This is a frivolous lawsuit.

I can’t stand Shamalan and his movies, but Servant is freaking excellent!!

Gregorini is the cockroach here.

That’s like a photographer who had shot Eiffel Tower suing me because I shot Eiffel Tower too. How’s this make any sense. No how, that’s how!

Go home b.

P.S. Watch IMDb rate numbers for the movie skyrocket in the next several weeks because of this lawsuit. Perhaps that’s exactly what b wanted.

...uses the same "cinematic language,"
Ha! I almost fell outta my chair laughing! What utter and complete horse$#!+. It’s sounds like they’re trying to write a parody comedy sketch about lawyers specious litigation.

Every film that has ever been made has borrowed cinematic language from the movies that came before it. That is literally the foundational principle of motion pictures’ evolution as an art form. This lawsuit is likely entirely due to the fact that The Truth About Immanuel got a 41 on Metacritic and its braintrust saw Apple’s war chest and figured this was their last gasp at breaking even.

I wish I could sue for having this nightmare fuel shoved in my face over and over. In no way did any show I watch suggest I wanted to see the trailer once let alone before every episode. At the very least I wish I had an option to hide it from my menu.
