That's not how trademark law works. At all.

They're not even (remotely) in the same field of business for a start.

So, which of these three logos for my new company developing language software will be tolerated by Apple:

Or a black square with a forward pointing slash above it? One round-shaped fruit with a stem trademarks all remaining round-shaped fruits with a stem? Food v tech industry — this is com-pearing apples and oranges ...

That’s a decision to be made by their trademark attorneys, and is really no concern of yours.
 
This is insane. The only reason why anyone would confuse that logo with Apple's is only because Apple brought it to everyone's attention with this suit, and even then, no one sees it.

Couldn't the logical reason behind this be that Apple wants to get into the Prepear space? We have Apple Watch monitoring health and vitals, so I think the next step could be watching what we eat. I don't think it's purely about logos being similar. As mentioned by a previous poster, Apple has been down this road before when Apple Records took them on. Apple agreed to not enter the music industry, and look where we are now.
 
Unfortunately, and generally at the expense of some good regular folk sometimes, crappy, abusive legal maneuvering and positioning exists - outside of what any normal human considers rational - such as this lawsuit- for the benefit of those that can burn cash, to allow the continuation of those operations that allow the entity to continue to burn cash, because the down to earth humans that work for that entity are too small individually to stop the continuation of the crappy abusiveness. And the people that bring the crappy abusiveness are modern warriors of the word that can ruin regular folk or regular companies with a placement of a few words and a few legal filings, especially when they have a trillion dollars burning behind them supporting their crappy abusive intent.

I'm also an Apple Fan Boy, always have been. Can't back Apple on this. It's kind of not even close. Different industry, different fruit, different color, different shaped leaf. Nobody is going to see a food service, see that green pear and think of Apple. It's a stretch. I'd rather see Apple use the money to fight this towards a 17" MacBook pro roll out. But that's just me...
 
It looks nothing like the Apple logo. Apple's legal department needs some applied corona. I still remember when Apple was sued by Apple Records for the exact same thing. Apple agreed, as part of the settlement, to never, ever, get into the music industry. Then came the sosumi beep sound and the rest his history.
Actually, the hole in the leaf is an almost exact copy of the leaf on the Apple logo. Easy fix, just change the shape of the leaf a little, tilt it to the left and I think Apple will not contest their use. Probably most people wouldn't notice the change.

There are other, non-related logos that are similar in some ways to Apple's that they don't contest. Pear should just change their logo's shape.

Check out Apple Holidays (Apple is tilted, bite in the apple, leaf tilts to left), Apple Vactations (red apple, leaf tilts to left), Green Apple Travel & Tourism ( apple looks like a globe with two leaves to the left). Probably some others if you look around.

It’s not about Prepear themselves. It’s a deterrence case to prevent many companies creating fruit logos (with leaf pointing to the right side of course) because eventually logos will appear that look much closer to Apple’s.
The argument is dull. They sue people who aren’t doing anything wrong to deter other people who might do something wrong 😑
This pear 🍐 doesn’t look anything like Apples logo.

If I owned that company I wouldn’t give Apple a penny. Not 1 cent. There’s no reason too. Their logo looks nothing like Apple’s.
