I'd like to see this argued in court. Then watch the judge fine Apple for frivolous litigation, and court fees. Then ban Apple from harassing fruit and veggies everywhere. Bad Apple.
 
Wouldn’t they have to sue like the Nickelodeon shows that has the parody laptops with the pear logos too lol
My neighbor once said to me (in all seriousness) that she wants an iPhone and the only other she would consider is the pear phone. Spent the next 30-40min explaining to her this thing doesn't really exist.

Apple really do push the bounds of hypocrisy sometimes. standing up for small businesses my ass! so any fruit logo is now owned by the big bully in the room. Puke.

Eventually, Apple did massively enter the music space, clearly making money from the kind of “products” offered by the likes of the Beatles company. And now Apple even produces media (Apple TV). But by then they had grown enough muscles and bank accounts to win the final fight.

Still, I agree with those who say that the pears should be left alone. It is a pity that Apple has turned from a rebel into the money making machine. Let’s be honest, with the size and umpf Apple has these days, unless they **** it up themselves, nobody would be able to eat into their fruit. It would be a nice gesture to drop this with companies like Prepear. Instead focus on the Chinese companies that blatantly try to mimic logos to sell into the same technology space. But would you dare such a move Apple?

Just imagine some farmer suing other fruit tree farmers, that the shape of their fruits looks too much like his Apples?

Did Apple go after orange investments? There are others. Do any of the following create a similar commercial impression?

Cmon. Dumb lawsuit aside (I agree it’s dumb and selfish), but getting sued by Apple was kinda the best thing that happened to this developer. As if any of ye would know this company otherwise.
They’ll come out the other side better for it. Logo intact or not.
 
Apple has an obligation to defend their trademarks and servicemarks even in questionable cases or risk losing their protections. I don’t think they care if they lose, really, but they certainly need to ensure people are careful with coming close to their marks.

I will have to say that is true. In the 80' and 90's I worked in the Corporate Television department at American Express Company and saw that they had lawyers go after any company that go anywhere near "do you know me" or "don't leave your xxx" without it" It was a form of a warning for companies to stay away from anything that MIGHT infringe on our advertising.

That would make sense. If too many logos are created that look too similar then eventually there isn't enough uniqueness to set it apart, making it generic and something that can't hold a trademark. Therefore you must defend against logos that are too similar.
Exactly, because it might be kind of close, but not quite there. Each time it might get closer and when it gets to the point where it's almost a copy the courts will say "those others are just as close and you did not complain" now a precedent has been set and there is no going back.
 
my brother opened a mini store for selling juice last month, the logo is a kiwi, shall i tell him now to close the store immediately?
 
If indeed their negotiations are consisting of them changing the icon in tandum with Apple's feedback could they declare their new icon as designed in cooperation with Apple? I think it would be decent press to be able to say Apple had a hand in designing a company's logo.
 
When is a pear an apple? When Apple's overinflated ego requires it to stamp all over tiny companies.
