This is probably more of what this is about than anything else. An overly cautious lawyer/legal team that want an official ruling that this is not at all like the Apple logo. If they ignore it someone at some point might make a simple fruit logo that does in fact have a striking resemblemance to Apple's and may use this particular logo as supporting evidence that Apple doesn't defend its logo. Perhaps...Apple has an obligation to defend their trademarks and servicemarks even in questionable cases or risk losing their protections. I don’t think they care if they lose, really, but they certainly need to ensure people are careful with coming close to their marks.
Exactly. It's like when Apple Records tried to sue Apple Computer. In this case, it's worse. Apple is one of the biggest and most powerful companies in the world, and they are bullying a company that offers recipes for children to make. This is dumb honestly. I didn't see the pear and think of Apple - they aren't even in the same industry space.
As far as I understand it is not.Actually, yes it is.
You're prepared to tell me that any fruit with a right-angled leaf, in any field, with any color will call to mind Apple as a commercial impression? And you think you can convince a Judge of this?Apple claimed in its filing that Prepear's logo "consists of a minimalistic fruit design with a right-angled leaf, which readily calls to mind Apple's famous Apple Logo and creates a similar commercial impression
You would need to show a.) intent and b.) that it would happen to your average person. Not that it's possible that just one person might. Meaning you can't say "people are stupid" and then use stupid people as your baseline.I don't think this is as ridiculous as people seem to think it is. People do get confused by stuff like this. And even the ones who don't at a conscious level are still subject to unconscious processes that relate things like these logos together.
Well they stole their Name and Apple type logo from the BeatlesIt’s not about Prepear themselves. It’s a deterrence case to prevent many companies creating fruit logos (with leaf pointing to the right side of course) because eventually logos will appear that look much closer to Apple’s.
They did and said they'd never get into music which, of course, we all know how that went..Well they stole their Name and Apple type logo from the Beatles
Hey, “ “stem“ from the need”. Nice word play.IANAL but doesn't part of this stem from the need to vigorously defend trademarks or they just disappear. On the outside this looks super stupid but it could be the lawyers feel its necessary.
Far from the greatest company on earth my friend. I have purged 90 percent of my money flowing into apple, last to go is my ipad , phone and watch. I already ditched apple one, and all other subs to them. DONE. this is beyond petty for them to go after this company for this bullcrap. Buh by apple, Hope you ROT! Any fanboy to support their move is just as bad as Apple themselves. This crap needs to stop. Their shiny junk is not worth it.What a ****** move from the greediest company on earth. The logos look nothing alike. It’s like they just want to ruin every other company in existence.
Nobody said the settlement involves money. In fact, it almost certainly doesn’t. It likely involves the pear company adjusting its logo.settlement? who would pay them a dime?
How are they “bullying” anyone? When the pear company applied for a trademark, apple filed an objection, because in their opinion allowing the trademark would dilute their own famous mark. This isn’t an issue where people would be confused about the logo, etc. Apple didn’t sue, apple didn’t demand money. They simply told the trademark office that they objected to the logo.Exactly. Im not so sure. This is Job's wheel house. Destroy anyone defiles or competes with the almighty fruit.Steve Jobs is rolling around in his grave.
In other words, the lawsuit has no merit, other than an incestuous one inside the legal system itself. This is probably one of those situations where they have to fight it in order to prevent future issues with logos that push the envelope even further.
