Doesn't matter he is flying over people/roads and if his youtube channel is monetized it is now commercial use and that is also illegal. Also it looks like he is over the 400 foot limit in some of those clips, if that is the case that is also illegal.
Good luck trying to prosecute. The legality of drone flying is a very dynamic part of the law right now. This administration does not want the AG to start filling up the court system with small fish cases that may create a quagmire of jurisprudence.
We are right now in a Golden Age of Drones where anyone with the skills and materials can build one and sell it for a profit with little regulatory rules. It is akin to the early barnstorming days. From that, anti-competition laws trumps over any interpretation of safety or regulatory acts to further the economy. Several start-ups are marketing drone-centric, for-profit business models with the full approval of the FAA as they don't want to violate anti-competition laws. One in particular, I am investing in right now.
There are dozens of cases in the court system with land owners shooting down drones above their property. The recommended action for the AG right now is to make shooter the defendant for vandalism. In the barnstorming days, farmers were regularly shooting at biplanes flying over their property claiming trespassing because the airplane was spooking the farm animals.
From that, the Bureau of Air Commerce was set up (predecessor of the FAA) to determine property rights concerning who or what can fly over their property without it being a nuisance or trespassing. Issue is the small size, maneuverability and remote operation of drones hit a huge legal gray zone of FAA and local regulations. Initial rules that you are claiming are still up for interpretation as rules set out have yet to have any competent court challenge. They also have yet to pass any legislative review as they are just proxy executive actions.
Eventually, we'll have an interpretation and adjustment in the law but not til hundreds of groups and laws are brought to review for this new technology. I don't see this happening before the decade is out.
