Why not? They're a multi-billion dollar company, and software is supposed to be their craft...yet, they had seven chances to get it right, and didn't.
How about Google and Apple? Both companies were very rich and it took them years to get to where they are now. Also, it took them two tries. WM in general was one attempt + a ton of fix attempts. WP7 is their first fresh attempt after Windows Mobile/Pocket PC, and they got it so right this time I can't even stand it anymore.

Who cares what Windows 7 is based on or if it's a different architecture. The R&D, UI know-how should have been there from all their previous experience.
Ugh, please keep up with the terminology. I'm talking about WP7 here. Attention span issues? Every company makes mistakes. Microsoft did, big time. But WP7 is truly their big fix, a fresh start for the smartphone market and, like I said, it's nothing like WM. Before bashing it, at least give it a proper try.

The Lawyers don't think so... it's not to say Apple doesn't come up with sexy hardware and UI's, but to say that Apple always invents everything is very irritating.

In reality it was an operating system. Think about what an operating system does (the core basics if you will) and Windows did that.
If that's what you think, I'm not sure you ever actually used DOSSHELL 7.0. (often called "Windows 3.1")

Funny thing is, Apple has become worse than Microsoft and IBM, two companies they were so dead set against in the past. Now that's hypocrisy.

TechFlash now reports that Apple has hit back at Microsoft in the dispute, arguing that Microsoft has failed to prove the generic nature of the term and takes a dig at Microsoft and its own work to secure "Windows" as a non-generic trademark.Apple response points directly to the alternative names used by other companies for their own application marketplaces as evidence of the non-generic nature of the "App Store" term, and notes that the company has taken steps to protect the trademark from becoming a generic term by reaching out to entities that have used it improperly.

The U.S. Patent and Trademark Office will now consider the case and determine to grant Microsoft's motion or allow the trademark case to go to trial for a final resolution.

M$ is going to lose face on this one. Apple has owned the App Store name with a vengeance for at least 5 years. The arguments over this being about whether Apple is claiming to own the term "app" is stupid and ill-conceived.

Arguments about the App Store being literally a store that has apps, is just plain silly. They could've called it the "App Shop" or "App Place" or "App Market" or "App Depot". It's a dead talking point.

Bottom line, Apple owns the mind-share for the phrase "App Store". It isn't generic. Of course everyone knows what the App Store is, and of course everyone knows what the App Store offers, but most importantly in this case, everyone knows who runs it.
 
"App store" is both stupid, and generic. (Ugh...calling programs "apps" is becoming increasingly maddening...)

Whether Windows is generic too is not relevant to this, and anyway Microsoft doesn't sell "Windows", they sell Windows 7, Windows Vista, Windows XP, etc. This isn't App store Vista or something, so it's not the same thing regardless.

Maybe if they spent more time actually bringing great things to market like Apple they wouldn't spend time and money on wasteful BS like this. Skewed priorities and lousy management at MS causes retarded decision-making, causing them to look like idiots in major growth markets.

Yet another reason Apple has MS in their rearview.

Fix your lousy consumer products, MS. Fix your mobile stuff. Fix your OS. Quit adding complexity on top of more complexity. Quit promising things today that you'll only manage to deliver 3-4 years AFTER someone else has already perfected the idea. Quit shoving bad OSes onto 1000000 different hardware configurations. Start paying attention to detail. Grow some balls and take risks. Start making your own hardware and start controlling the platform. Stop whoring out your bad software to anyone that can slam together a box. You didn't actually win the desktop wars, you just licensed your crap to everyone, so that eventually everyone was running different versions and configurations of the same crap. This is why you make Apple look so brilliant these days.

It's all about priorities. Pursuing Apple over what Apple already chewed up and spat out; getting people to install cameras in their living rooms so they can jump around in front of their Xboxes; being late to market with stuff someone else did better two years ago, etc. The list goes on.

I hope MS loses (not that "winning" in this case will make any difference for them), because it might finally wake them up to market realities, namely, that they're a lame organization that can no longer compete on product strength (I can't recall the last time they really did) but on licensing rackets.

Why not.... its called fishing.

They have billions in the bank, they have an army of top notch lawyers, Apple needs them (as in Microsoft) and Apple has little leverage to exercise against Microsoft. Look at it this way, if they did not challenge it, then Apple wins. If they challenge it and it is not upheld, the Apple wins and they are out an insignificant amount of money.

You mean something like TRIM, Open GL 3, a vector based UI? These are all areas where Microsoft has delivered and Apple has not or not to a significant level. Sure, there are also areas where Apple kicks Microsoft butt, just saying it cuts BOTH ways.

DIfferent approaches. Cannot argue that many windows systems are crap (e.g. the 299 AMD special at BigLots). With that said, we should also accept that having an OS with the flexibility of Windows is something that should be admired. I think we all owe Microsoft a tip of the hat.I like the fact that Windows has a more 'hands off' approach and not force you to resort to technical hacks to get get the OS onto the system of your choice.

I is known that Microsoft has referred to Applications as "Apps"...Longer than Apple.

Windows Mobile 6.5 has had times when they refer to them as "App's" too

So by the same logic Apple is using,...

Microsoft should be allowed to block Apple from using the term "App" All together !!

Now don't go all fanboy on me guys,....

I'm just pointing out a fact.
