No, you misread my post. I paid for an upgrade to an SSD when I purchased the machine, which ran blazingly quick. Apple when replacing my logic board the second time in a 4 week window somehow determined my SSD was 'bad' (it wasn't) and replaced that as well, with a refurbished part that was clearly slower, benchmarks or day to day use.
 
They already started giving out loaner phones while the customers is repaired at another facility.

How soon until Apple gets sued for that?

I still don't get why the lawsuit is dumb. How else would Apple be compelled to start being transparent about giving people refurbs?

As I said, I don't think most people have issue with refurbs. It's just when they have their Store employees tell folks getting white-box replacements they're getting brand new phones, that's deceiving.
 
I'm on your side in this issue but I cannot agree with that.
Every refurb iphone unit I have ever had (iPhone 6 and iPhone 5 at least) ALWAYS had something wrong with them..more often than not dead pixels.

on the contrary none of my retail bought iphones ever had any real defects...

I am the complete opposite as you. I have had countless new in box units replaced for defects. I have never once had a refurb iPhone, iPad, or Watch replaced. My refurbs have always been better than original. Refubs go through a much more thorough testing before the consumer gets it.

And when I say countless, I mean at least a dozen new in box devices.

The iPhone 4s problem was so bad, this was over the span of 3 days, that I specifically requested a refurb unit. No, I was not being picky with the 4s, the screens were so yellow that green text bubbles weren't even legible. Same thing after my 3rd 6s, I asked for a refurb unit. My final 4s was flawless and now my 6s is beyond perfect. This does not include my iPad and Watch experiences as well.

I will gladly accept a refurb unit any time.

Def not true. And this is what apple wants you to think. Can't tell you how many iPhone replacements I've received with wear and tear on the sides. Scratches on the screen. Once the phone had the old users Apple ID logged in.

If this the a replacement you received from the Genius Bar, something happened with your replacement devices. All refurb iPhones from Apple have a new case, new battery, new screen and so on. The only thing reused are the chipsets.
 
I think these people, or should I say their no doubt pushy lawyers, were emboldened by that recent judgement in the Netherlands, where a judge sided with the plaintiff in an almost identical case.

Personally, if the case is unblemished and the battery is as good as the one I surrendered, I couldn't care less if some components are refurbished. After all you do get the balance of the warranty, but I do understand some people are very, very picky.

It remains to be seen how our judges deal with this issue.
 
I personally haven't seen Apple-refurbished replacement iPhones going for any less than their non-refurb counterparts on sites like Swappa, eBay, and Craigslist when the condition of the two devices is the same. As far as I'm concerned, mint condition is mint condition regardless of whether or not the device serial number starts with a "5".
 
AppleCare plus is relatively cheap compared to the AT&T insurance plan I had. Admittedly, that covered loss but still, very expensive compared to AC when you factor in the monthly fees plus the really high deductible.

If Apple is forced to give out new iPhones then they'll need to jack up the price of AC which is bad for me and all the others who would be satisfied with a replacement that is slightly less than perfect.

Maybe there's a middle ground where if it breaks within 30 or 60 days of purchase, they replace it with a new iPhone, but any period beyond that, they replace it with a refurb.

I like this idea. Or maybe two AC plans where you can choose between a new replacement or a refurb replacement...with the latter being cheaper coverage.

Other people's mileage clearly varies, but I've purchased two refurb iPads from Apple in the past, and with the exception of the boxes they came in, they looked and functioned just like new. One was an iPad 1, which is still going strong today.
 
I don't blame them, this "equivalent to new" thing that companies do is pretty lame. If I buy a new device, and a week later the device turns out to be faulty due to manufacturer defects, I expect a brand new replacement. Hopefully they win and companies stop doing that crap.

At the same time, you can buy a device, used it for 11 months and speaker goes bad. Phones has scratches all over. Why should Apple take in a phone thats worn down and replace it with a brand "new" phone?
 
Oh yes, they are not equivalent. BTW the refurbished ones are more reliable lmao, they are better instead of being equivalent.
 
I would blacklist them if I were Apple, cancel their iTunes accounts and restrict them from ever activating an Apple product again ... let them go to Android.

Are you joking? These are people who have paid a lot of money and probably worked very hard to save to buy a Apple product. Surely, it is Apple who are the greediest and richest company in the world. I can't understand why some people stick up for Apple when it's so damn obvious that Apple are interested in one thing only - profit. Sales, sales, sales and to hell with everything else. The sheer stupidity of people on this forum who stick up for Apple really makes me sick. What sad, geeky sub humans. Seriously people, get a life! Apple is the greediest, old company that has ever existed. They are an embarrassment.
 
My experience. If the Apple device is within the 14 day return period, you get a new one. Outside that window, most likely get a replacement device. I have no problem with the current policy at all.
 
I thought all the parts that receive wear and tear were new parts?

- New case
- New screen
- New battery
- New buttons
- New connectors

Basically the only thing that could be "used" is the PCB inside? Something that doesn't suffer wear and tear at all?

People are either idiots, or greedy. I'm gonna vote for the latter mostly.

Not to defend anyone, but what led you to believe that? I've not read anything from Apple to confirm their definition of refurbished.

The terms mean "good as new" not "new." Stupid, frivolous lawsuit by wasteful idiots who want to pretend like there's a functional difference. Also, they want Apple to issue a refund NOT for devices that are defective, but also that consumers break?! Ridiculous.

How does labelling someone an idiot is this case not get a ban but aim yah at a member and MR ships you off to Guantanamo?

how many times the word refurbished is actually used in the explanation is simply marketing, but not illegal or even misleading to mention it only once.

as someone who has either received for himself or his family apple's "equivalent to new" replacements, over the past years, there has been absolutely nothing wrong with these replacements, not even a tiny scratch. i don't know how they do it, but they obviously have a great system in place.

I have bought Apple refurbished iPads, Macs, iPods on many occasions. I bought them because they were cheaper and you can't tell that they aren't new.
The fact is, unless you know you bought refurbished there is absolutely no way to tell. Refurbished devices even get a new serial number. These people are wacky to expect a new device. Assurion, SquareTrade and a host of other companies only send new when refurbished is not available. AppleCare gives you a device of like quality and function.

These people have no idea what refurbished means.
This suit has no merits.
 
I can understand this.

Apple gave me **** replacements a few times.

My first iPhone, a 3GS, developed hairline cracks in the plastic.

I paid for AppleCare. I bring in the phone. They replace it with a refurbished on that had a "sunken" screen. It was lower on one side, and the plastic body of the phone would scrape my face.

I got tired of that and brought it back. They replaced it with another refurbished iPhone. This one had a bluish display, a stiff Home button, and some scrapes on the bezel.
I asked for a different one. They told me that they cannot just replace an iPhone because the Home button was stiff (this was during the iOS 3 days, and there was no task switcher - so no real reason to need to quickly double-click the Home button).

Eventually I just bought a new display off eBay. Got rid of the blue and gained a clicky Home button.

When I got my iPhone 5S, the battery would drop by several percentage really quick. Like, a 30% down to 10% or something (I'd have to go search my notes).

Apple replaced it with a refurbished iPhone 5S, of course. The one they handed me had visible drop damage. I handed them my original iPhone 5S in mint condition (other than a flaky battery) and they replaced it with a beat-up 5S?? I nearly threw a fit at the Apple Store until they went and got some more refurbished iPhone 5S models for me to dig through.

I was able to pick one out that didn't have any visible flaws.

I'm OK with Refurbished. I know it's tested. If it LOOKS new, and has a FRESH battery, it's fine. If it doesn't look new, they shouldn't try to push it off on customers.

The plaintiffs are family and friends of lawyers looking for settlement opportunity. Lawyers don't have enough work to keep themselves busying or make the world a better place for others.
 
Apple does a lot of things wrong these days, but I'd still prefer a refurbished computer from them over a brand new one...

Name one manufacturer on the planet that guarantees in writing that you can bring them a used device for warranty replacement in the U.S. and receive a brand new, off-the-shelf device in return. Companies give people in the U.S. refurbs all the time as warranty replacements. Get a grip.
