This was probably it. If these things weren’t shown, he probably would have gotten a warning. I think they guy was knew his daughter was filming for her “vlog” but was unaware of the content she was showing.

You nailed it. I totally agree, especially about the bullying. She’s a sweet kid and they are clearly a loving family and decent people. We all make mistakes. Everyone here making these righteous posts should ask themselves if they ever made a mistake.

It really is sad. People taking badly about a person that until recently was hard at work designing products you all love. I don’t get it. As Americans, we are losing empathy and I don’t get it.

One can feel empathy toward this young woman and her dad while still understanding and supporting Apple's decision. Yes, people make poor hasty decisions and pay for them with their job or worse. But this wasn't done in the heat of the moment—the dad had sufficient time to consider the consequences of his daughter posting her video prior to release and decide that it would be safer to err on the side of caution and tell her not to post it (or even make her erase it if he felt that she might not follow his instructions.)

Unlike Canada, there is no presumption of continued employment in California.

As a result, there is no situation of ambiguity regarding severance pay for most CA companies. If it’s not written in the agreement, there is none. The employer will also ask employees to sign an at-will statement. You can try to sue any employer, but it’s not going to work.

Yep, you're right. That's much more favoured on the employer side than what we do up here. (here we'll just pay severance to terminate the relationship without cause). With cause is a different matter - and may not be eligible for severance (really depends on the case and potential for litigation).
 
...the CEO of the company is likely to be one of the only people with the authority to do something like this. They wouldn't though. They are more intelligent than that. That's why they were named as the CEO by the Board of Directors. This numbskull clearly didn't rise to that level for a reason and didn't honor his NDA.
I think the descriptions such as numbskull are unnecessary. He made a mistake yes and probably misinterpreted his actions as being ok because this was shown after the event not before or during the event.

I don't think it boils down to intelligence here, if Steve Jobs, Tim Cook or Jony Ive wanted to leak it they could. In fact, if Jony Ive leaked it, the Board of Directors and the CEO would have to look the other way and just say 'keep leaking Jony'.

The daughter should have just waited until 12:01 am November 3rd and I think the father would be in a better off position. Might have gotten a reprimand, but not this. Also, give him credit, he has been working at Apple for 4 years now. Which means, he got through the door working at one of the most admired companies in the world.

I sense bitterness in a lot of the replies like - he deserve it because he was working at Apple and I can't. Thats what I keep getting more of out of this.

They will relocate whoever they need to. Even from other country.
You know a competitor is already hiring this guy and he will give up every secret or the secrets will wind up in a competitors hands even if he's not directly giving them secrets. He will say in meetings well the way we solved this problem over at Apple is... XYZ.
He won’t because - (a) he has both an NDA and a non-compete to which other employers will request to see what is known as “restrictive covenants” prior to hiring and (b) he broke the rules and got fired for cause someplace else. He may have learned his lesson but he is tainted. Like an ex-convict trying to find a job. And if he starts selling trade secrets he will face criminal charges.

He will fail his background check if he didn’t disclose to his employer that he was terminated for cause, and if he did disclose, he would have to explain it. You cannot hide from this.
I'm an engineer myself and everyday I read articles and see companies saying there's not enough engineers etc etc. So what's the truth.
Companies are mostly saying “I can’t find good domestic talent, and this is why I need to outsource and sponsor visas”.
 
I also wonder what severance package employees receive on top of an embargo from being hired at competitors.

I doubt it. It’s probably the opposite. Stock is typically vested 100% upon termination. Future stock allocations will of course not happen as he is no longer employed there.

But every company is different.

No, the board can reserve to fire anyone not looking out for the interests of the company. That includes not respecting company confidentiality. In fact the one thing you do not see is Tim showing off his phone. You see it accidentally slip out of his pocket, but he is absolutely not doing unsanctioned demos without his marketing team controlling it. He would never show you what’s on his phone... he would show you a wiped demo device.

Certain Apple employees are eligible for restricted stock units (RSUs) which vest, can be granted and more importantly can be canceled.

He also forgot the part where he was told "ANYONE YOU BRING ONTO THE CAMPUS IS YOUR RESPONSIBILITY. IF THEY DO ANYTHING WRONG IT IS YOU WHO WILL BE HELD RESPONSIBLE"

Yea he forgot those parts *roll eyes*

Maybe he should get checked for Alzheimer's or something. Not joking.

I quoted a member that specifically talked about bullying. Also, some people here have made very harsh comments. I agree that we can be empathetic toward someone and still understand Apple policy.

I personally don’t agree with Apple on this one and explained why but this comment was more about the hate that has been thrown their way.

nah she is just a youtuber. over dramatic and acting go hand in hand for fake your emotions youtubers. Not saying she is faking her tears. Just you tubers tend to act and ham it up. Thats what I mean.

I think Apple's reaction in firing this engineer was misplaced. His daughter innocently filmed a brief video while her family lunched at Caffe Macs. Once she posted her YouTube video, it went viral which was never expected. However, The hype and excitement it built for Apple consumers was a benefit not a detriment.

I went so far as to email Tim Cook this morning as I thought the over reaction from Apple was too harsh. He could have received a stern warning - instead he is now unemployed. I've just always thought of Apple as a caring compassionate company but they took this way too far.

All these other leakers like Benjamin Geskin or analysts like Ming-Chi Kuo knowingly profit from relaying information about Apple products. There was no intention for Apple's engineer to do so and he did not intentionally violate company policy.
Yes - he made a mistake.

Sounds like he should have eaten at Seinfeld's famous Soup Kitchen.

I think dad allowed daughter to do this because he wanted to be fired. I noticed in her youtube video explaining that he was fired, she stated his job title, mentioned he was working on iPhone X, hinted he was a long time employee, vouched for his character, and stated his family status. She was selling him. I've heard that dad probably signed an agreement when he was hired not to go to a tech company and share Apple secrets. However, I bet he finds a legal way to get even better job. This could have been planned from the beginning. He could have been unhappy about something at work. He is getting his resume circulated far more better than if he had just quit and tried to find a job.

I completely agree about the bullying, which unfortunately has become the norm in our society. In part, that's because it's easier to do this when you're doing this anonymously, but it also happens when the identity of the poster is clear.

Exactly, these guys with leaks and pics don't work for apple so they can do what they wish. Those that do that get caught are out quickly.

Termination for cause is a career ender, not a career starter. It’s like a ex-convict trying to get a job - “why did you leave your last job?” “I was terminated for breaching confidentiality”. Yeah that isn’t going to be someone you’d want to hire either.
