This is the most brilliant win-win. Win: Apple can shut down Samsung if they find something they can sue for/argue with. Win: Apple sees ALL the design and engineering, so they can learn from the superior design ideas and laugh at the flaws and clumsy bits.

No one has shut down Samsung. This is a legal proceeding, not an outcome. The evidence was obviously compelling enough for a judge to agree that tangible evidence be examined by the court. It might then be submitted as evidence in the matter. The evidence will be examined by legal council, not software and hardware engineers (unless they are called to testify as subject matter experts on specific points).

Funny, here I was thinking that you're the one that wasn't getting it.
 
The LG Prada was released in the spring of 2007, and the iPhone in June of 2007. If I'm not mistaken the iPhone was actually announced prior to the release, and announcement of the Prada.

Wrong. LG Prada was shown at a design show and won an award in September 2006.

there's only so much u can do with a touch smartphone design wise, they all kidna look alike ^^ more or less plastic

Here is the thing that I learn from all this legal crap: Build whatever product you want and DO NOT SELL IT IN THE US. You actually don't read that much patent BS in Europe or even Asia, and both are huge markets.

And when I drink another Martini tonight, I might even get better ideas than that. Prost! ;-)

Hey, I am giving the benefit of the doubt here. Motorola created something and they obviously like it and I am sure some of their customer do too. When it comes to UI everybody has an opinion, but at least Motorola is doing something original. Maybe I should have said "many original UI designs" instead of "great". But yes, I also prefer the stock Android UI to the skins that are out there.

I thought people got iphone/mac because it just works? Not because something looks like an iphone?

And before you bash me as an apple hater, check my previous posts. All my pcs are Mac and I have a 3GS.

whether something is ugly or not is a matter of opinion. i was simply pointing out that you can make a smartphone that doesn't look like an iphone, but you missed my point.

some other ppl said that the samsung galaxy s 2 (what a stupid long name btw) looks just like the iphone if u flip it bc of the home button, now look at all those HTC phones, they also got the home button exactly at the same spot. saying they copied the home button feature is redic, and i dont mean u by that and btw, the first 2 u showed have physical keyboards, they dont count

Samsung copied, as long as you only look at 1 picture from 1 specific angle. Looking at the Samsung Galaxy S i9000 from all angles tells a different story :

The bezel looks "the same" from the front, but on the side, you can see it's much different. It's also a darker shade of chrome. The back is completely different from the iPhone 3GS this is supposed to be copying.

Basically, it's only the same if you use cherry picked pictures and angles.

As for the "UI" being the same, that's not the homescreen you're seeing when you look at the grid of icons, that's the App Drawer. The homescreen on the Samsung TouchWiz GUI looks like this :

Again, copying is in the eye of the beholder, don't let Apple's fanbase numb you into a frenzy against Samsung. This case isn't so quite clear cut as many make it sound.

Let's not even go into the other models (Captivate, Fascinate, EPIC, etc..) or the Galaxy Tab. Those don't even come close on a hardware level.

if you can't see the obvious striking similarities (ie the samsung is a cheap knockoff looking version of an iPhone) then you're either blind or just down right anti apple for the sake of being anti apple.

obviously there are some solid points to it or the court wouldn't have granted access to the devices in the article.

Cherry picked picture aside, look at all the angles of the phone, and you'll see how you're being mislead. Better yet, compare both phones side by side for real and come back and tell us with a straight face you could confuse them.

That picture is not even scaled properly, the Samsung phone is bigger than the iPhone by quite a margin.

you miss the point, bravo. the promo pics for the samsung is the one i use in the post above, plus as you admit, it looks the same from the front, which is where most people actually look when you use the phone. you're really clutching at straws commenting on the back, etc and you basically admit it's copied from the iPhone when you look at it from the front! lol.

as i said, the majority of the promo pics show the phone from the front with the interface that copies the iPhone this may only be an "app drawer" it's still a useable screen on the device, so with that being part of the promo pics with the front on pic of the phone looking like a cheap knockoff of the iPhone it's pretty clear cut.....

if it's really not a ripoff like you claim, then why did the judge grant apple access? the claims have solid ground to them or it wouldn't have happened, so you've already been proven wrong before you started....

it's not cherry picked, i searched samsung galaxy s just now on google images and 99% are all similar looking shots of it looking like a cheap iphone knockoff with your "app drawer". it's like selling a hoodie with nike logo at a slightly different angle. just cos it's a slightly different size doesn't mean it's not a ripoff!! lol.

people on here are pretty much tech minded, but joe public can easily mix them up, i showed my mates galaxy to one of our less tech savvy friends who at first glance mistook it for an iphone.you have to remember that not everyone pays a huge amount of attention to technology. this place is like it's own little bubble world.

gotta protect your IP.

Now if Apple were suing HTC for one of theirs, you would have a valid point.

The judge will look at the devices themselves, and as the devices go, it's not so easy to claim 100% certainty that they do look the same. :rolleyes:

And while Samsung Galaxy S II might sound "stupid", at least they came up with their device's name for themselves, instead of taking someone else's trademark and only asking for permission after releasing the device, like some other fruit vendors did.

thanking you for proving you failed to even read the article. All apple even gets is a plastic shell. Nothing else and that is assume that Samgsung does not appeal it and keep it tied up in the courts.

Also I noticed people are taking the pictures to compared by looking at the App drawer sorry that is not the home key being pressed to bring that up. Home screen on the 2 are very different.

i read it fine, the fact apple get anything just shows that there are grounds to apples claim.....

the app drawer is used in the promo pics and it's still a blatant ripoff. claiming it's not the home screen doesn't mean squat.

Why do people keep thinking the Galaxy isn't selling? Maybe in America, but in South Korea, it is incredibly popular. I see it more often than the iPad in public, but I imagine it is because it is smaller.

Because Samsung is from Korea.

Ok here's my average joe opinion. I just picked up an iPhone 4 and was looking at possibly returning it. But I have decided to keep it. Anyway, when I was at the Best Buy, I took a gander over the other phones. I saw the Samsung Galaxy S Vibrant for Bell and the Samsung Galaxy S Captivate for Rogers. I was told they were both the same phone. Now first off, I felt both phones were very nice. The Samsung screens were gorgeous, I would have to say even nicer than my iPhone 4. I was immediately taken back by the screen size and amazing contrast of colors. I was also told my iPhone 4 screen is supposed to be sharper. To be honest, just looking at the screens I couldn't really say that my screen was sharper. I did absolutely no research buying my iPhone 4, as I always assumed it was just the phone to get. The only reason I was even looking at these other phones was because of the possibility of me returning my iphone 4. Now with that being said, there is no way I would confuse any of these phones with a iPhone 3GS or my iPhone 4. And this is coming from me, a new iphone 4 owner. I will most likely buy the next iPhone, but I honestly can't say I will not consider something else, especially a phone with those amazing big screens. Again, this is just the average joe opinion, meaning I'm not a tech geek.
