Boston law firm Block & Leviton today announced it has filed a class action lawsuit against Apple on behalf of iPhone Upgrade customers who are dissatisfied with how Apple handled iPhone 7 and iPhone 7 Plus pre-orders last Friday.

When customers who participate in the iPhone Upgrade Program went to pre-order an iPhone 7 or 7 Plus, they were forced to reserve a device from a local Apple retail store rather than being able to make a traditional online purchase. Many retail stores did not have sufficient stock to meet demand, leaving some customers unable to select the model, color, or storage capacity they desired.

Many iPhone Upgrade Program members were unhappy with the ordering process and an inability to reserve a desired iPhone for launch day. Apple has responded to customer frustration and has been collecting customer information to attempt to get customers their iPhones as soon as possible. Apple's efforts have not, however, prevented today's lawsuit, which claims iPhone Upgrade Program users will face future upgrade delays due to the situation.The lawsuit asks Apple to reimburse iPhone Upgrade members who are forced to make extra payments while waiting for a new iPhone, make upgrade members eligible for a 2017 iPhone in September regardless of upgrade delays, and seeks to require Apple to make all of its iPhone inventory available to upgrade members.

Apple's iPhone Upgrade Program, arguably designed for the company's staunchest fans, allows customers to upgrade to a new iPhone each year. Customers can upgrade after as little as six months, so long as they have made 12 iPhone payments and trade in the iPhone in question when upgrading.

Really? This is part of the problem with the medical industry, people sue for ignorant things. I don't get the entitlement of people today. Apple doesn't have to sell you an iPhone. They can make anyone go to the back of the line if they want as well. To sue over something like this is just plain stupidity and entitlement.

Seems like this is a violation on contract which is exactly something that you should sue for.
 
I almost just fell out of my chair laughing and I was one of the people who didn't get to choose the phone they wanted with the IUP.

Every participant in this lawsuit should have to wait until it's settled before getting a new iPhone. Hopefully the iPhone 12! Ridiculous!

Apple is contacting them by phone because Apple also believes the process sucked and they want to rectify it. It's not simply because they are afraid of being sued, it's because they have excellent customer service...

They did the same for me last year when I wanted to return my apple watch, excellent treatment, pushed me to the head of the line to get a watch of a different size. That's what the Apple Tax gets you.
 
This is nothing more than lawyers trying to get rich.

Either they are looking for fame in saying that they are the law firm that filed a class action lawsuit against Apple whether they won or not or they are looking for the money that comes from class action lawsuit.

The reason we get $.50 or one dollar out of the class action lawsuit these goons file is That they get very rich off of the deal.
 
You mean the upgrade program is ridiculous? Yes.. yes it is.

Just pay full price and sell on swappa every year.

Yeah. No. That's a waste of money. I am getting a gaurenteed 50% return on my device using the program. There is no gaurentee of that when buying full price and then selling. Sometimes you can get 55% and other times you can get 40%. I don't like gambling when I have a for sure thing. Plus no hassle of selling or risks of getting scammed.
 
I'm new to the upgrade program this time and was crazy enough to order at 3am. This is a pathetic lawsuit. I had thought previously a separate portal to preorder and require your serial number but even then the likelihood every demand is unrealistic. I get it, people are mad but to turn this into a legal issue is beyond me. I loyal Apple fan would know Apple will make it right.
 
First come, first serve folks. Just because you're already in the upgrade program doesn't give you premium access to a new iPhone every time.

i think the problem here is people in the program were actually locked out of pre order due to some issue with apple's system, so while there was supplies the ppl in the program were not able to access it.
 
The reason why there are so many lawyers = idiots like these who bring frivolous claims. We have a lawsuit-happy nation. I don't blame the lawyers. If idiots want to file a suit and will pay a lawyer, this is what happens. Whether or not it gets tossed out is another issue (and I agree this suit is totally ridiculous, these people are pathetic and deserve nothing).

The McDonald's coffee lawsuit though was absolutely legit, contrary to what the ignorant public thinks. The woman suffered 3rd degree burns over 6% of her body, spent days in the hospital, needed skin grafts, debridement.

Getting an iPhone late, I have no sympathy for the people or the lawyers. These clowns were not damaged at all and are all spoiled 1st world entitlement minded brats.
 
Meh, put the ones who need to finance their luxury device... behind the ones who can buy it outright.

Maybe they'll rethink their priorities.

Thank you both. Unlike most lawyers that give the good lawyers a bad name, I have a conscious and cherish my sleep lol. I know I will have moral and ethical questions down the road but I believe I will always do the right thing. That's just who I am.

This is pathetic! I know it's frustrating, but people will get their phones whe. They get them! I pre-ordered and got to wait until 4-10th October!!
