That's where the textualist interpretation of the Constitution becomes out of vogue since a strict conservative interpretation would not entail a judge trying to determine what the historical meaning was but rather use the text only; which would require squaring the militia preamble with the rest of the text instead of ignoring it. As I said before the rioters weren't affiliated with university and were outsiders. Students held peaceful protests before the riots occurred. He's not egging people on to think.
