There's a pile of money in this. Apple, however, has already taken steps with respect to this issue.
Seems to be only after being caught.
Do I expect Apple to have to pay. More than likely not. I also expect CarrierIQ to get off with out having to pay. If anyone is going to end up forking out cash it will be the carriers and some of the hardware manufactures.

It is how the information is collected and if you were even given the choice to opt out

Wouldn't my cell carrier know every call I ever made? I mean, they are making the connection and all. I bet they also know my location based on the cell towers I am connected to and the time I placed the call.

They know when you use their network but that is far different than knowing what Apps you run, text messages typed and so on.
What web sites you visit over wifi.
 
Could you link me an article in which Apple allowed this to be knowingly opted in? Because everything I have read has stated that Carrier IQ has been running in the background without customer's consent or knowledge on any platform.

Again, lumping this in with a million page T&C required just to operate the phone in my opinion doesn't constitute "opting in".

We stopped supporting CarrierIQ with iOS 5 in most of our products and will remove it completely in a future software update. With any diagnostic data sent to Apple, customers must actively opt-in to share this information, and if they do, the data is sent in an anonymous and encrypted form and does not include any personal information. We never recorded keystrokes, messages or any other personal information for diagnostic data and have no plans to ever do so.

This is the opt-in question you get when setting up an iOS device for the first time. You are opted-out by default. The complete text is approximately "Do you want to share diagnostic information anonymously with Apple?"
 
It was very clear that Apple was collecting diagnostic data in an anonymous method and you had the option to opt out. There is no "article" to read. Just read the data presented to you when you activated your iPhone.

I don't think Apple will have problems in the trial
 
What really makes me angry about this is their attitude that "we only collect general statistics and nothing spcific about individual users is kept" or something similar. People will defend this as much ado about nothing, others keep even more tracking about you, its all anonymous, etc.

But what these companies don't understand is, I don't want you to track ANY information about me, anonymous or not. I do not give you permission. Period.
You should be angry with yourself. You did not read the terms and conditions of your contract when you "agreed" to them. You also did not pay attention when you opted in to turn on sending of diagnostic data when you setup the phone.

Not paying attention is no excuse. You agreed to it. If you did not turn on the sending of diagnostic data then I don't see what your problem is since enabling it is optional and if you don't enable the feature then nothing is sent.
 
People can be tracked by any cell phone, with service. It doesn't need a GPS installed. Regardless, I don't think it is a matter of being "tracked", rather a matter of private information being recorded and sent. This would include anything ever entered into the phone, such user names and passwords for websites, credit card numbers, text messages and emails.

I could not agree more.

As an aside, at the end of the day most of us are aware that most anything we post to the internet, is subject to whatever said parties want to do with it. Yes, it may even be beyond the terms of service we agree to, but that's the way it is. And it was like that prior to the internet.

Privacy is but a myth that slowly died away a long time ago. We are left with mere fragments and illusory visions of what was once true privacy. That's simply how it is. I don't like it and I suppose that none of us do. But the horse has already left the barn.

When I see "diagnostic information" I'm thinking if an app crashes, if my GPS can't pull a signal, etc. Something to help the manufacturer root out and fix bugs. Carrier IQ was collecting personal data such as keystrokes and the like. That is not "diagnostic information" in a logical sense.
 
The only thing I am unclear on by this is while Verizon doesn't, Motorola was named. So did Moto load this on their Droid phones used by Verizon? Why would Verizon need to load this if their top manufacturers already were?

Carrier IQ is NOT used on any Verizon phone. AT&T, Sprint and T-Mobile requested it be loaded on their phones by the handset builders. There is a new app in the Android Market to see if you have Carrier IQ on your phone or not. I tested my Droid RAZR on Verizon and it came back "There is no Carrier IQ on this handset" so I know it's clean.
 
By that logic - people want cars to travel in - but complain of being followed and stalked. Really??
By that logic, you would expect to receive directions from a person on the street without revealing any details concerning where you are travelling to?

@TWSS37: How would you expect Apple to figure out why Safari crashed if they don't know what website crashed, what you were doing at the time and other related information?

Because Apple is the biggest, most important company in the world, and the others aren't.

Yeah, but this is Verizon we're talking about. The real question is what even-more-suspect alternative did they use instead.

And Apple collects none of that data. Period. It is that simple. There is no indication that any Android handset transmitted that data. Period.

Most of the hoopla (not all but most) is a result of many idiots typing on their keyboards when they do not know what they are looking at.

Android is the biggest offender in this.

Its the carriers putting it on their phones not the device manufacturers. I imagine it has something to do with the American government wanting it in place for some reason.

CarrierIQ collects different data on different phones. Exactly what we dont know. On the iPhone, however, we know for sure it is not the stuff you are talking about.

That does not mean there is not a CarrierIQ like program running. It may be as simply that Verizon uses a different company to sub-contract their code to or does it in-house.
 
If phines didn't log SMS content, how would they be able to present texts in the "conversation" format?

I dont know im not American. All Emails, Phone Calls and Text are monitored by GCHQ in the UK at least. I imagine the American government will do something similar.
