That sounds right. I hope (but doubt) the lawsuit wil go away.

It will. The point of the lawsuit was that AMC originally said it was a 16 episode season leading those that bought the pass at the top to believe that is what they were getting. Mind you that is a way low price by current standards but still. Had they been informed it was only the 8 from day one then it would be on the buyers.

The renaming decision was not Apple's so really they shouldn't be part of any lawsuit but the legal costs for defending themselves on this issue is likely higher than the refunds etc. After all they are only giving it to those that bought before 'the final season' came out and they would have numbers to know the sum. And you can bet they told AMC they aren't getting any money from the free copies and perhaps not for the refunded ones either, for their guilt in the matter.

So there is no reason for the lawsuit, Apple gets some PR points while making it clear it wasn't their call. And so on

As for the actual pricing. I think it's high time someone does something in general and I wish someone would file a lawsuit about it. Lack of parity with disc releases in terms of features as well. Pity the DOJ doesn't look into that.

----------

I bought Season 5 when it came out, and now got refunded money to go towards the Final Season. So people who bought Season 5 should get a refund.

The key is 'when it came out'. If you bought just the final Season or bought both after the final season came out you knew exactly what you were getting.

Folks that bought season 5 when it was the current season had no way of knowing it was going to stop at 8 until the new season came out. Those they get the refunds

----------

Tomorrow, we will talk about the completely separate "deluxe editions" that are in no way upgradable if you were crazy enough to click "Buy Season" for the regular one. I bought the "regular" copy of "The Hobbit" when it came out. Now there's an extended one with extra footage and stuff, and you gotta buy the whole thing instead of upgrading. Guh.

Yep. The extended I kind of get but still don't like. But those 'box sets' that are the same eps and a bunch of features. Why not let those that bought during the season pay like $5 and 'plus' up

----------

. I imagine they will charge them for every season pass they sold,

Other way around. Studios pay nothing. They get paid. AMC won't get any money from these free copies cause no money came in. Not to mention loosing money for the refunded ones likely.

And they will have agreed to this cause if not Apple will be happy to toss them under the bus in court and get the suit dismissed as not Apple's control or decision.

----------

I'm confused. If you only purchased the current running season ("Final" part 2), are you entitled to a refund? I didn't purchase Season 5 (so-called "Final" part 1).

No. You knew exactly what you were buying. No refund.

Anybody outside the US been offered the refund?

If not they ought to be wording it to say that it's because of the US lawsuit that US customers are being offered a refund and not leaving it like a good faith gesture in response to any confusion.

Right. And I, like you, think this settles that complaint. I'm just confident that lawyers might disagree. I'm not really concerned about a potential lawsuit hurting apple, since they are providing the correct response, I just hate these types of lawsuits.

I would bet every penny I own this isn't coming out of Apple's pocket ;). I imagine AMC are footing the bill.

True. Good point. It's 70/30 AMC/Apple.

But if it's coming from AMC, then why is only Apple (right? anyone else yet?) offering the refund? You'd think they'd be obligated to do the same across the board...otherwise why do only iTunes customers get a free season?

Either way, they offered a product, I bought it, end of transaction. I get the feeling people are playing dumb just to get a free lunch.

----------

So clever, yet so lame. I bought something. Why should I retain the product, AND get my money back? I knew the deal, and I paid for the show. It wasn't a rip off. Show me anywhere else that offers both halves of season 5 for $20.

You want something, you pay for it. You want your money back, give the product back. No one is entitled to anything. If you were the one selling the product, you'd be singing a different tune.

It's not likely coming from AMC. More like Apple has the brass balls to call them out over the issue and told them they are eating it on this by losing their 70% just like Apple is on their 30%

But no one else had the balls or perhaps the contract allowance to pull it off
