What they might do is split the global menu bar into two sections separated by the notch. So, you will have a long pill shaped File menu on the left then a pill shaped status bar on the right.

Apple will say this frees up more screen real estate, you get Face ID and unifies the Mac and other iOS device experience.
That's pretty much the only reasonable way to do it. If it would contain just icons you can't interact with it'd be pointless - in most cases I DO want to interact with the icons that are there (or I don't want to see them at all). If that area (and the icons) were above the menu bar and you could interact with them it'd screw up the easy mouse movement - you hit the top, you're at the menu bar.

I really hope they have at least that much common sense left. Not too optimistic, but at least I don't have to buy a new laptop this year so I can wait for them to realize their mistakes should they make some. Again.

From the info in the MacOS betas, this appears to be in a bar which is extra to the normal screen resolution. So you could potentially have a menu bar, split into two sections, with a full-screen below. I have very few, if any, apps which need more than half the screen width to display their menu anyway so the notch would not upset me at all if it's implemented in that manner.

Am I missing something?

According to the text in the patent the screen at both sides of the notch are not part of the main screen area, will be always black and are only used to display information (e.g. clock , battery status, etc.). So you can free space in the main screen area! So it seems like the menu will be below the notch, as usual, and the notch will not interfere with the normal screen.

So I don't see the problem at all! and since the new MacBook Pros are supposed to use mini led, the background of the extended region can be made pitch black!

Seems like a good use of otherwise unused space, if is implemented as described in the patent.
That sort of implementation could work well on macOS, so effectively you still have your full desktop, but a new status bar above it in an area which would previously have just been bezel.

Yes but imagine editing a photo in a full screen mode (which I do all the time) it will be so annoying to not see the whole photo
Did you not read the article? The patent specifically implies this is to be treated as a rectangular display with two additional extended areas. Your photo is only going to be on the standard rectangular display. The additional areas will allow for still being able to see things like the clock and status icons when in full screen mode.

If true, wouldn’t it be interesting if Apple were to extend the notch the entire width of the screen, then, you would have a nice clean uninterrupted rectangular work area, especially in full screen mode?

here’s a chance for Apple to try to add something without taking something away. Like adding a touchbar without taking away tactile function keys. Maybe this will be a good thing.

If there is a notch, and if they implement this, then this is brilliant. Basically, from my comprehension, they are going to have a blacked out area on either side of the notch only displaying icons (computer status?), then the menu bar will continue right underneath as always. That way they reduced the bezels while not screwing up the menu bar area.
