Give them the stuff about the misrepresentation of goods, and collateral contract, and the fact that they gave you confirmation forms a verbal offer by you to buy and an acceptance for them to sell. All I needed to do was to say that I actually ordered the 40gb one, not the 20gb one, and that I was unhappy at the way I had been dealt with. As I rang them to give them the legal spiel, they were updating my order. It has the two accessories on at 1p each.

I also mentioned in my email complaint that I had read that some people had their orders appended with the 1p items, and that I was unhappy at the inconsistent line taken, stating that I felt like I was being unfairly treated.

OK, I called Apple UK again about this today. Again they were very helpful and again they said they'd send the accessories. It sounds like the standard brush-off email they're sending out is directed at people who bought the 40GB after the web site was changed. Or maybe they're trying it on, I don't know. Either way I've had another verbal confirmation that they're aware of the issue and will see us right on it. I hope this is my final word on this - i just want the frigging iPod now or I'll cave in, cancel the order and spend the next 2 months waiting for a 60GB model! ;-)

40 GB iPod accessories

Well, I just got off the phone with Apple sales support, and had partial success. They stated that the current spec sheet does not show the remote and case as included, nor does the description of the item at the store. However, they offered to send me a case free of charge as compensation for the error (oh, well, I'd prefer a wireless remote anyway).

They also said that my iPod was coming from China, so shipping might be expedited, but offered no guarantee regarding this...

However, if your HD is spinning all the time, power management software probably won't help much, anyway (the first thing power management software does is spin down the HD whenever possible).

Sorry; I didn't make myself understood.

The probelm with the battery finishing in 2 hours would be fixed by newer iPod by USB2 charging 😉. Imagine charging your iPod anywhere (it's a PC world. You can find USB the same way you find power sockets) having only to cary a small cable, not a whole adapter.
My iPod works for up to 6-7 hours in normal operation and it would still be boosted by the new software to (they say) 11-12 hours, that is great.

So all I hope for is USB charging (and hopefully better battery). Any of this posible by an oficial (or hell: non-oficial) software update for G3?

About Small Dog: the battery life would be no problem (5-7 hours) but here's the problem: they only accept G1&2 to buy a new G3.

EDIT: Regarding Small Dog: aparently they accept all iPods up to the click wheel ones (4G): and they would get my 40gb (dock) for $225. It's not practical. I think I will hold on to the one I have now and hope Apple releases a software upgrade for the 3G with USB2 charging and better batery management. Or maybe some unexpected buyer will show up to my door with a good price. I'l just let fate drive it's course.

Email from Apple

Ordered 2 40Gb iPods (engraved) at 10:00AM on Monday and just received an email that due to overwhelming response, my order is being delayed for at least another day...if you want one, you better buy it soon.

I ordered monday night, how great would it be if they pushed mine back a week or so and gave me the 20 GB dock or case as compensation. 🙂

The Tech Specs site lists that a remote comes with the 40G version, so the iPods still do have remotes... just not the 20G version.

I just received mine and it didn't come with the remote.
I don't see it listed in the Tech Specs. If it was, maybe Apple noticed and changed it.
I'm a little pissed. Yeah, it's $100 less then 3G but they eliminate $78 in accessories. That's a savings of $22! Thanks a lot Apple, you F*@$&'s!!!

Shipping and Usage Errors....

Could someone tell me who apple uses for standard delivery. I'm going down the shore, and I had ordered the new ipod, so it will arrive while I'm there. If it's USPS, I'll have no problem because they are going to hold my mail, but if it's UPS, I have to do something because I can't leave it on my porch for a week.

One of my accessories shipped out seperate from my 20 gig earlier this week and arrived the next day via UPS -> strange considering I payed for 2nd day, and my other accessory and iPod shipped FedEx 😕

FWIW, i haven't experienced any error messages yet on my new iPod. But i did have to update the software a second time before iTunes would recognize it. I'll post if i do come across some, hopefully it''ll be smooth sailin' from here on out. And in case it's of any consequence, i am using a Dell 340 Workstation and connecting via firewire.

I too had the delay email

I had custom engraving and had the same email. But it said it would be shipping in the next 24 hours.

That's nothing - I ordered my 20GB iPod within an hour of it being announced and it was supposed to ship out by the 22nd. Instead I got an email saying it will ship by the 26th! My guess is I'm getting bumped because I live in Canada, and I ordered it with the educational discount 😡

Hey Raypang,

How long did it take them to respond to your email query? I sent them one two days ago and have not heard anything back yet, let alone had anything updated (which it seems won't happen anyway)... thanks.

They didn't actually respond. I emailed them on Wednesday evening, and as I was calling them on Thursday morning I noticed my order being updated. They told me it was being updated as we spoke. Keep at them about it. If they confirmed to you that you would get the extras, then (my understanding is that) they are obliged to supply the extras. If they haven't confirmed the extras then it's a little bit less clear cut.

It was listed on Tech Specs on the UK site until very early Tuesday morning.

Now I don't understand why you're so annoyed. It's not as though you were expecting the remote, right? Or did they confirm to you that you would get it? In my opinion, a $22 saving is still fairly good. If you want the accessories, then you have the choice to buy them, and if you don't, then you get the savings - from what I gather, it's not universally accepted that both are worth having.

I'm planning on ringing up when it arrives (according to TNT, that should be today) and asking why I don't have a remote, case or dock. I figured that if I rang up before it was delivered, I might not get them anyway, but if I did I'd have to wait longer without any music to take around with me (driving me nuts!) and it would look like I was simply jumping on the bandwagon. This way, I may have a lesser chance of getting them, but I'll already have the iPod 😀

Now, why on earth did it go to Ireland, only to be flown back to Belgium and then onto England? That just seems wholly illogical to me, but meh...I guess I'm not Apple 😉

mine arrived yesterday 🙂 glory! everything is so good, except that even this fourth generation model doesn't have crossfades...

I called yesterday, about not seeing my order on the site, and they were all like...."It's not in the system, for some reason it didn't go through." Here's my response:

"..."

"Well, we can just re-order them now, and give you one day delievery for free, and ship them from CA instead of from China, and they'll get there tomorrow."

"..."

"And give you a case as well."

"Sounds good."

"Ok, thanks. Bye."

They should be there when I get home from work.

Hooray, cool for you! They're pretty good about upgrading shipping.

I ordered Tuesday, still didn't have a shipping notice. The Tysons, VA store has plenty in stock, so I called to see if I could cancel. They said it's already "in the process of shipping" so it should go out tonight. I can wait, I have no choice now! ;-) Hopefully mine isn't coming from China!! 🙄

4G 40GB Arrived!

40GB 4G ordered Monday at 8AM CST arrived in Missouri Wednesday at 2PM. Carry case and remote arrived Thursday. 858 songs loaded so far--the click wheel is SWEET! My wife has a 3G and likes her touch buttons--I guess we're both happy! 2 iPods on separate iTunes on same Win PC working great--so far this thing has been flawless!

Ordered first AM Monday (engraved) was supposed to ship by the 22nd

Now it has been delayed to ship by the 28th!!?? I know engraving takes more time but I figured that since I ordered early the first day, mine would be pulled as I hear Tuesday orders have arrived in some cases.

Anyway this is a second one for a good friend-suppose to be a secret surprise. I have a 40GB 3rd gen with over 8000 songs. I figure by the time I fill it up, a 60 or more will come out. :

I got engraving too. Sometimes Apple sends out emails telling you it'll be delayed, but it ends up going out on time. That happened a lot with the first G5s. You can call them and find out if it's really been delayed or not. Most stores probably have them in stock by now anyway.

Mine arrived early this afternoon and I have to say I love it. It's so much easier to use than the 3G - it even beats my old 2G in terms of usability. And, it's tiny! No cloth-bag packaging though, 🙂() so I'm going to have to make one by the looks of things. Grr.

So I've also ordered up a 20g ipod and of course I (am having fun) torturing myself over which one to keep (although I'm leaning toward the 20g). One of em's going back. What to do!?
If you only have 1gb of music currently, and you want to use it primarily for bike rides, I would definitely go with the Mini. There really is a quite noticeable difference in size, and for long bike rides, those subtle differences in weight really come out. When your music library expands enough that the 4GB isn't enough space, you can either get a regular iPod to supplement (which will probably at that point have more space, be smaller, and/or be cheaper) or get another mini which at that point will probably have more hard drive space.

I got a similar email, but I subsequently got an email that it shipped today (also ordered on Monday, with engraving). Shipping out of China by FedEx (just requested standard shipping). Estimated delivery by July 27 @ 12 noon.

Well I ordered mine on Monday evening in the UK, but I still got the following email today:

I'd like it to arrive by Thursday, as I want to show it off to my girlfriend's brother at his birthday do. I organised buying a 3G 15GB for his birthday last year (best present he ever had!), so I think he'd be interested ;-)

Delays?

I received an email saying it would ship within 24 hours, but the order on the web site says ship by 7/28. I didn't receive an email saying it would be delayed, but I hope...

I'm off on vacation in Early August, I want to make sure I have it by then...
