I’m sure there is language in the TOS that you agreed to that let’s them contact you in specific situations.

There is not.
As a habit, I always opt out of EVERY SINGLE marketing emails.
An unsolicited email is count as spam.

Did you read the TOS, every word, all of it? I can guarantee you, that apple has some language in there, else they would be open to a class action lawsuit.
 
About 10 years ago I saw Mac ads on television all the time. The “I’m a Mac” campaign. But I don’t think I’ve seen any Mac ads on TV for the past few years.
Why pay insane amounts of money on advertising with a limited consumer penetration? Web ads are far cheaper and reach multitudes more potential consumers.

TV ads have their use but it is not the “end all” of marketing as it once was.

I spend quite a lot of time everyday on the web yet the commercials I remember most are the ones on TV. I don’t think I even see Mac ads on the web very often except when I come to this or other Apple related websites.

Oh man, Apple's got it this time.. How did they know? All I need is 1 or 2 more ads and I'll be brand-aware of iphones. 1-2 more ad viewings and I'll be dropping $749 to upgrade by iphone 6... Am I the only one that wants them to learn a hard lesson?

The imagery was gloomy:
  1. Colored jumpsuits (faded) --> Prisoners
  2. Setting --> Depressing Eastern Bloc brutalist architecture
  3. Motion --> Escape/frantic desperation.
Should've filmed in the dark and copied the Beijing Olympics:

I like eastern architecture although this much symmetry was more popular among the nazis and still is in the us.
 
I think it’s a cool ad (I’m a parcour fan). I’m wondering if these ads make any difference in buying choices though. Obviously Apple thinks so.
 
What a garbage ad. Time to hire TBWA\Chiat\Day back!

They still use TBWA\Chiat\Day. Or technically, Media Arts Lab, TBWA\Chiat\Day’s offshoot that was started originally (in the Steve Jobs years) just to handle the Apple account. They don’t use them for everything, but they use them for a lot, and I’d be surprised if this wasn’t there work as well.
