Been there, done that -- OS-9 vs Mac OS 9

Yep, we (I used to work for Microware) went through the same thing over Mac OS 9. Indeed, Apple made it impossible to find us by searching for "OS-9" (search engines don't honor punctuation, it seems) and the newsgroup comp.os.os9 STILL gets posters there asking Mac questions.

To this date, when I try to search for an OS-9 resource (just yesterday I was searching for "OS-9 SAMBA" to find an OS-9 implementation) the Microware OS-9 product links (which formerly would have been a #1 result) are now lost in a bunch of Mac results.

Apple won the lawsuit, and the "OS-9 operating system that runs on PowerPCs" versus "Mac OS 9 operating system that runs on PowerPCs" was a far more similar thing than "Mac OS X 10.4 that we call Tiger" versus "Tiger Direct is our retailer name".

Tiger Direct doesn't stand a change. The Apple lawyers are just that good.
 
Anyone else notice that a google for "tiger" brings tigerdirect up *second?*
Hmm... seems the articles is a little... wrong?

I used to buy quite a bit from Tiger Direct. In fact, over the past year, I've probably purchased $10 K in goods from them.

I just sent them an email telling them that I've removed their name from my bookmarks list. This is a frivolous suit and adds nothing to their business plan - offering competitive pricing on computer hardware and software. I'll stick with suppliers who are more interested in taking care of their customers than in filing frivolous suits.

It won't take too many people like me to hurt them far more than the extortion money they're trying to receive from Apple.

The Jacksonville Jaguars' original logo looked "kind of like" the logo for the Jaguar Motorcar, and they got sued and had to change it to the now familiar "severed head" version.

Lawyers.
 
Tiger Direct just wants attention. They may get it but they just lost my business (and I have purchased from them before). I think the whole thing is childish.

Hmmm...if 10.4 were a TigerDirect product, it would have to have a retail price of $399.95, and then come with forty six rebates which bring the price down to $9.95. And there would have to be some mention of executives at major OEMs who "didn't want you to get this deal from us!" :D

If Tiger Direct's claim relates to their rank from a Google search, shouldn't they be sueing Google!?! Might as well try. They will have the same chance of winning.

What it comes down to is consumer confusion...two similar products named the same thing is obviously a problem, but here we have a computer mail-order company vs. an operating system. You'd have to be really astoundingly dumb to confuse the two, so I'd guess this case isn't going anywhere. Is IS amusing that it's Apple being sued in this case though.

Seriously though, I could understand if Tiger was just some made up company name (ala Microsoft or Verizon). That makes the name unique and I can understand why a company would be upset if there was confusion. However, Tiger has been around for centuries and Tiger Direct probably took its name from the animal, as does OS X. In my opinion, if Apple takes this to court, they make Tiger Direct look foolish.

Give Tiger Direct a phone call. They will have to pay for the call. Also, be very nice to the person on the phone when you complain. You want to talk to their manager's manager. They are not at fault.

This is the lowest of the low. I could see a Microsoft executive giving Tiger Direct a special break on pricing in exchange for this action. This Stinks!

I think they're just wasting their time. This is nonsense claim and case and they should just drop it. Yeah if they really wanted a case they should have attacked Apple last year when it was originally trademarked...

Guys and dolls, it's pretty obvious why Tiger Direct is suing now, THEY DEAL PCs!!! Business must not be going so well on those home shopping ads :D .
 
Sick the Tiger on em!!!

A low grade lawsuit from a lowgrade company. Tiger Direct are bottom feeders in the PC market. They sell crap hardware via direct mail. I hope they throw it out. But this is what happens when you're successful. The timing is real nasty. I wonder how much Apple could counter sue them for if they have to stop the Tiger roll out?

Your "tiredness" is misplaced-- you should be angry with litigious, publicity-hungry companies, like this Tiger outfit, or SCO, or Microsoft (which is on a big campaign to enforce the bogus patents it has been amassing. This is a business seeking an advantage, and has little or nothing to do with lawyers. /lawyer :D :
