Totally agree with Mark Menacher, Apple politics now is more bussines like and the customer satisfaction is into second place! iOS is big fail in terms of design... It is mostly copy-paste from Windows metro flat design - no innovation it that point. Ok you will say - iOS7 has great features - yes it is, but features can be added in any design - for example iOS6.

iOS7 is more commercial thing, try to use iOS7 on iPhone4 - it is slow... while Android updates for Android phones - in every update speeds up animations and overall performance, but Apple strategy is to kill iPhone4 and 3Gs culture to speed up pumping new phones by making software more self-rigorous for old iPhones. And more than that, lot of peoples don't buy every year a new phone, First - because this is sick and second - there is more important things where we can throw our money... But Tim Cook is not a visionary person and more than that - he don't have charisma, he is ordinary businessman.

When i look on old iOS6, 5, 4, 3 etc design i don't see only design, i see love - its cannot be explainable in any words, you can feel it...

when i look on iOS7 (there is only technical design - no soul, no love)

Exactly this. People insisting on sticking with iOS 6 really get under my skin. There's no need for it, regardless of what bonkers statistics and things you can come up with for why it's better than iOS 7. Update and live in the current.

Is there currently a jailbreak for iOS 7? No? Then ill live in the past so I can still watch live sports with my location faker app.. Two thumbs up for living in the past.

Plus I travel Globally with work. Some apps I pay for don't work in other countries. Jailbreaking fixes this issue. Until that's resolved then my iPad stays on iOS 6. My iPhone 5 is on iOS 7 tho.

actually the automatic download IS annoying

I saw this happen on one of my devices and I found it frustrating. I booted the device up specifically to test one of my apps in iOS 6. I intend to keep that device on iOS 6. There certainly are reasons why someone would want to forgo the iOS 7 update.

This guy has a valid point. He likely bought the phone with iOS 6 on it and is set in his ways. That's fine. Apple owns the OS, but they don't own his iPhone. He is not breaking any EULA by failing to upgrade. He may have his reasons. We don't know.

That said, I've never had an iOS or an update automatically download on me. Must be because I never leave > 1 gb of free space. And by this logic, if he's leaving this much space available, he shouldn't really complain it's being taken away. J/k. He bought the phone with x gb available to him, he should have x gb to use.
 
I've just about had it with this community.

First, you can't sue for disk drive capacity (which is what Apple has reduced by automatically downloading iOS 7). The courts this guy is going through require some sort of monetary compensation, and $50 was probably the lowest you could go on the forms (if it wasn't, it's a very reasonable amount considering how much space Apple has removed from his device and how much that device is worth).

[A new breed of poster] that has arisen in wake of Jobs' departure is bordering on religious zealotry, and I'm sick and tired of the arrogance some of you have to tell other people that they should "just upgrade and get it over with".

The fact that the majority of you are siding with the corporation rather then your own individual freedoms and preferences is pathetic and disgusting. I don't know when some of you decided to become Apple's personal Stasi, but the fact that you can no longer think for yourself and make your own decisions (probably because you're too used to Apple doing it for you) is extremely disconcerting.

This guy has every right to sue for what Apple is essentially holding hostage. How would you feel if I broke into your garage and filled it up with unmovable, sealed boxes? How would you feel if I said I had to come and renovate your house to get rid of those boxes, that everything you've gotten used to will be changed (sometimes not for the better)? You'd tell me to hit the road, and then you'd do everything in your power to destroy or move those boxes in defiance.

So why is this any different?

As other people have pointed out, on older devices, iOS 7 is slower. Even between iPhone 5 and 5S, iOS 7 runs smoother on the 5S, and 5 runs best with iOS 6, IMO. In any case, it's not unreasonable to want to run your device on iOS 6, not for the rest of your life, but certainly for the remainder of the device's useful life. I know some people who have iPhone 4/4S still on iOS 4 or 5. They work perfectly fine for how they use their phones, and they don't want to bother with upgrading. That should be their choice, they shouldn't have to give up storage space to not upgrade.
I have no experience with iOS 7 on iPhone 4; seemed fine on a 4S to me. There's no performance hit with iOS 7 on an iPhone 5. Even on my iPad 3, where iOS 7 is more sluggish than iOS 6, it's still a faster experience because of the features and improvements in iOS 7. Safari loads pages far faster, control center makes accessing common settings far faster, the swipe to go back feature makes navigating all built-in apps far faster, the "top sites" display in Safari makes accessing my bookmarks far faster, to name a few.
 
I would love to join the lawsuit. It really pisses me off that Apple forces everyone to upgrade. I hate iOS 7. I refuse to update. It looks like a kid came up with ios7. It is awful. It sucks. I am quite happy using iOS 6. My iPhone and iPad do everything that I need them to do perfectly with iOS 6. Apple creates this ios 7 crap just so they can have something new to offer. New does not mean better. There was nothing wrong with iOS 6. Apple forces obsolescence.

iOS 7 on the iPhone 4 is practically unusable. Much like the iPhone 3G was with a previous iOS version (5 or 6, I can't remember). As much as people in here are screaming "get with the times," I can understand somebody not willing to update to preserve their device functionality. At the very least, Apple should include an option in the software update settings to turn this on or off, and if you turn it off after the download of the new OS, it should delete the update and free up the storage on the device. That's not exactly rocket science. And if the person decides to upgrade to the new iOS at a later time, they can sit through the download process at that point in time.

I don't like litigation, but this is one suit I can at least say is not so unreasonable. I definitely agree customers should have the opportunity to somehow keep the upgrade files at bay until they are ready for them. Unfortunately, the plaintiff loses much credibility in his written complaint.

One more point: do I have a special iPhone 4? I ask because I feel as though my phone runs more smoothly on iOS 7 than it did on iOS 6. I had some emergency financial obligations come up in the past week so I will need to delay upgrading my phone for a few months, but I don't mind at all. The move to iOS 7 has been delightful.

Nobody's forced to upgrade. Keep iOS 6 on your device, do a restore, enjoy the extra space from not having the installer on there.

I am quite happy using iOS 6. My iPhone and iPad do everything that I need them to do perfectly with iOS 6.

So continue doing everything perfectly with iOS 6. (PS. People were saying the same thing when iOS 6 came out, except they felt "forced" to update from iOS 5, of course.)

Because they're moving forward? People said for a while now iOS needed a graphical refresh. Apple provided it. Some people didn't like it. The media's reporting on it like the sky is falling. Keep in mind no matter what sort of style Apple applied to iOS, some people weren't going to like it.

Also, a lot of people hated iOS 6 when it came out (especially Maps.) People hate iOS 5, too ("NOTIFICATION CENTER? Way to copy Android! Apple has really gone down hill. They need to get rid of Steve Jobs. Again.") Now iOS 7 is getting the hate ("It looks like a kid made it! Apple has really gone down hill. Steve Jobs would have never tolerated this.")

iOS 7 is better, across the board, but no it currently isn't perfect. It has a few obnoxious bugs, but nothing that renders the device entirely inoperable. Some of the apps installed on it could certainly use a revisit (particularly Music and maybe Calendar,) but none of them are as bad as some people on these forums make it sound.

I'm not being a fanboy, either, I'm just content with my device - and the software on it - enough that I'm not going to get fed up and spew nerdrage all over the internet because there's no more leather in my Contacts app.

No, things aren't going to stay exactly the same just because you're apparently an 80 year old man who just wants those damn kids to get the hell off his lawn.

Except that Apple does not support and does not have to support jailbroken devices, including the do not have to provide a way for jailbroken devices to stay on and old iOS. And in fact it is in Apples legal right to force you to update.

The only thing illegal in your situation is that fact that you are spoofing your location to get content that is not allowed in the area you are currently in (which is pirating)...
 

Apply should not FORCE somebody to go to their new fangled IOS7. If a user bought a phone with IOS6 and they like it, then they should be able to keep it.

No matter how much you love Apple (I own 2 MBP, 3 IPhones and 1 Ipad so far), they do not have the right to FORCE anything on anyone.



Lots of folks here are so pro-Apple it is bordering on a cult.

No, not really. My iPhone 3GS continues to run strong, however it will not load iOS 7. Why should I purchase a new phone, spend that much money on a new phone. It is because I am so frugal that I can afford many iPhone 5S all without blinking an eye. Still as long as my 3GS continues to operate I will continue to use it, when it stops working then I will upgrade. Folks, my car is ten year old runs perfectly, when my house needs painting I do not purchase a new house so, why replace a perfectly operating iPhone 3GS?
 
To be honest, I think he has the right to sue, given if he didn't enable autoupdate on his phone. Loosing 3GB on your 16 GB iphone is a pain.

I've seen many of my friends have mixed feeling about iOS7, some really love it, some was just "meh" and some loathed it. Therefore, it is reasonable that we respect people's choices.

I love IOS7 so far :D

By the way, it is weird that nobody sued Microsoft for misleading usable storage advertising on the Surface :rolleyes:

Except to make this a comparable situation, the situation would have to be I bought the Garage from you but in order to use the garage I have to sign an maintenance agreement, which enables you to fill it with boxes needed to perform regular (Free) maintenance. And I decide no thanks I dont want the maintenance, but the agreement doesnt say anything about you being required to remove the boxes.

Apple is not "breaking in" to your phone to fill it with "unmovable boxes". You have a previous relationship with them and they are providing a service, and as many have stated the files can be deleted, and are only taking up less than a third of the space claimed in the suit.

Fact is, Apple does not have to provide iOS for free with its iPhone, they could sell them without an OS (although they wouldnt sell).

Such a simple fix, unless you're jail broken: settings > reset > Erase All Content and Settings.

Done.

(Turn off WIFI at home to keep the firmware was re-downloading.)

What a great idea. Just don't ever turn your WiFi on ever again. You are a freakin genius.

I enabled OTA updates to be able to update, at a time of my choosing, directly via the device without going through iTunes...not to have installer files pushed to my device without my knowledge or consent
