I know this doesn't really help the original issue.. but this is a good example of why the 5S should have been 32GB/64GB/128GB...

I was hoping to buy a 128gb 5s.. guess i'm going to have to wait for the 6.
 
My wife and I got the iPhone 4s when it first came out. A year later I warned everybody I knew "wait and don't upgrade to iOS 6 until they get the maps worked out".
I upgraded after Google came up with their application for maps. My wife has stayed with iOS 5.
I envy my wife in a lot of ways but this is most definitely one of them.
I'm all for going to the next thing when it comes to change, But this is a situation where I wish I had stayed with iOS 5.
When I went with the 4s I had been saying, "the maps on this thing are worth the price of the subscription alone". Now I'm constantly thinking about jumping ship. But there's no ship that interests me. Don't tell me to Jailbreak, I use Square for credit card processing and it will not work on botched iPhones.
About a month ago I asked my wife, the attorney, "Is there's any way that I could sue Apple just to have iOS 5 forever?". That was the operating system that made me buy it and I liked it, and it worked and now my phone doesn't. I simply don't trust any map on my iPhone anymore.
Whenever we go on vacation and we want to get somewhere, we just use my wife's phone.
I have been looking on eBay for iPhone 4s with iOS 5. I get a sinking feeling though after spending 400+ bucks and then, what if the thing goes down? I'm not supported by Apple.
I am interested in this thread.
 
I think it's a fair and reasonable request. 50.00, no lawyer is more than fair.
Doubt it will garner any attention, but at least he made macrumors.

However, if apple fixes this- the board here will light up with high fives to this guy.
 
People and their selfish entitlements. Here's the solution. Update to iOS 7 and get over it. It's not that big of a deal. OR get a different device if you don't like iOS 7.

Then again, I guess you could sue and get headlines and money you really don't deserve. Yea, I guess most obnoxious Americans would go with option 3.
 
I think he's right in principle. If they choose to stay on iOS 6 why should it take up space?

And Apple can program the device to automatically download updates without actually breaking any law. And Apple doing so does not prevent you from using it however you want to.

Additionally, just like any other Update to any Software/Hardware/Clothing/Consumer good, there may be downsides to not upgrading. In this case apparently it means you lose disk space until you do upload.

Really all Apple has to do is say that the downloaded update is required to be on the phone in order for iOS6 to continue to function (silly statement but would be valid - and possibly backed by legitimate reasons to support new iOS7-only Apps or APIs)....

Besides, with how much the law enforcement agencies love the new iOS7 anti-theft measures, and trying to get everyone to update for this reason, they will likely applaud apple for trying to force the update (Im not saying this is in any way the right thing to do, but it is probably the sad truth)...
 
Just a bunch of yuppy hippies with Lawsuit happy trigger fingers. I highly doubt they even tried to contact Apple or go to a Genius Bar before filing this lawsuit. I'm sure this case won't even be seen by the clerk because I bet there's an article in Apple's Agreement saying they can do whatever they want once you click the "Agree" button. Ha ha. Serves them right.

It is one thing to say somebody should "suck it up and upgrade to iOS 7". But we live in America, and the guy has the freedom to stay on iOS 6 if that's what he wants. Basically what Apple is saying is if he wants to do that he has to sacrifice 3 GB of space on his device. This is wrong and if the guy went through the process of contacting Apple and they wouldn't do anything about it, this lawsuit is completely appropriate.
 
Would you be saying the same thing if Microsoft constantly nagged XP users to upgrade to Vista with popup bubbles and automatic downloads?

If it was a free upgrade, then yes I would want Microsoft to automatically download it. XP no longer has official support or security updates, and Vista while it has its problems (fixed in Win7), is still more secure and less vulnerabel to threats, I do not like the interface and the control panel, but security/stability/support is my first concern.

My wife watches me use iOS7 on my phone and hates the look and feel of it. It does tend to freeze up a fair bit. She's holding out on updating to 7 since 6 looks like an actual device rather than the plaything my phone resembles.

Although she's not an avid fanboy, she does have a grasp on what does and doesn't work. This article will interest her immensely...

All you're doing is reinforcing my point. Just because you don't mind a couple of GB taken up for an automatic update doesn't mean everyone should OK with it. Also, Vista did break a lot of things for a lot of people (including me) back in 2007. It was widely panned as an OS with serious flaws. I'm not talking about subsequent service packs.
 
Your undying and unconditional love for Apple sickens me. You are not helping Apple.

There are many reasons why some would not want to be forced to upgrade to iOS.

The main reason would be compatibility with existing apps. If you were an enterprise user, you might have inhouse application that currently do not work with iOS 7 and you would want your users to not be forced or pressured to upgrade.

Wow, simple option to shoose is No longer there. You buy our devise and than we,ll do it your devise what we want, hmmm. And asking not to is too much?
 
I heartily support mr. Menacher's cause.

This happened to me on my iPhone 3GS with iOS5 last year. It downloaded iOS6 without warning me, and since I didn't want the update (because of Maps), it just sat on my phone taking up 3GB+ of my 8GB. I already had 3GB of apps/music/data on it, so the normally quick and snappy device slowed down to an unmanageable crawl.

I hope he wins, and Apple will address this.
 
While I think having a legal battle is funny, Apple is wrong to automatically download a new OS. I'm all for being on a new OS, but what about corporate users who haven't had their IT test everything yet? What about internal apps that don't work with iOS 7 and crash?

For CMP, I'd wait until 7.1 is released so bugs are worked out and the company has time to check apps for their users..

The fact the apple forces users to update isn't as bad as commenters here telling others what they should do.
From company standpoint they want as much adoption as possible but from a forum reader it just proves how egocentric people are.

Simple solution: Install the iOS 7 download and get over yourself. iOS 7 is great, live in the now and not in the past.

Right. Great idea. Except that on an iPhone 4, which Apple sold up until just recently runs it like dog ****.

I havent read all the posts in this thread, but at least most of the people you are referring to are not really defending apple, and are not chastising the user for not wanting to upgrade. If they are chastising him for anything it is the fact that he filed a suit over the issue. And that he claims "Corporate Thuggery", when it does not sound like he contacted Apple in any way over the issue, or even went into an Apple Store to talk to a genius about a resolution (or they probably would have told him some of the methods people have posted in this thread to delete the files). In fact his statement "Apple's disregard for customer preferences in relation to iOS 7 is corporate thuggery", invalidates his whole case, if this is about customer preferences, most companies give you only the bare minimum options in their software/hardware, because they dont have to allow you to change settings. It pisses me off daily that MSAccess does not let me set the default window size of query windows, and I always have to resize them because they open way too big and are covered by other floating windows causing me to resize the query window every single time (Just because I personally always like the properties window open by default).

This is about the law, and legally there is no dispute here.

It may be Ridiculous to some to automatically download this update, but not to others. As I stated before, Apple made this product and provides the OS for it. They can program it however they see fit and that usually means what will sell the most units, and I bet research would reveal that automatic downloads is something that drives sales.

What most people are arguing is that a Law Suit is most definitely a Ridiculous way to attempt to resolve this, and he is in no way entitled to ANY amount of money from this minor Inconvenience.
