Will his change anyone’s mind, will anyone that was going to buy an Apple Watch say, I’ll buy that other smart watch with the blood oxygen sensor Instead? Nope, because you still get the hard ware and it’ll be renewables some way or another, or you just don’t care about it, or you do, and the Apple Watch wasn’t your first choice anyway.
 
All it takes is a software update payload when it connects to the internet during activation.

Again, they’ve already done this once with iPhone 15 on launch day. And they built a system to update boxed iPhones in-store for future instances.

I doubt they'll do this. Why would they go out of their way to disable it? When the ban went into effect last month, other retailers weren't immediately forced to comply. As per AppleInsider:

Anyone who purchased an Apple Watch before January 18 will have functioning blood oxygen detection. Those seeking an Apple Watch with the feature enabled will need to purchase one from non-Apple retailers, which should still have stock of the original models and are not required to cease sales.

Nope. US Customs already checked out the work-around submitted by Apple and gave its blessings to import watches with the sw fix.

'blessing'? The ITC said that it fell out of their scope. That is more a 'punt' (to Federal courts) than a blessing. Indeed the the feature is still banned by the Federal courts. It is their down the patent 'weeds' problem to work out.
If the ITC blessing was so strong , why does the Fed courts still have the ban turned on?



This portion is over and Masimo has less leverage unless a completely new jury rules unanimously in their favor. And that's only for their case against Apple that resulted in a hung jury.

So if they get a jury ruling they win. Apple didn't win every point against Epic.


They still have the case Apple filed against them in Delaware as well. IIRC, none of Apple's patents were invalidated and they appear stronger than Masimo's mostly invalidated patents (15 out of 17).

If Apple is aggressively trying to suck lots of money out of Masimo in a counter move there is little upside for Masimo to lay the smallest amount of groundwork to on their potential punitive claims.

Both sides are probably putting more money into lawyers pockets than they probably should.
 
This has been such a cluster for Apple. They may eventually win but personally I’m becoming disillusioned with their leadership, specifically Tim Cook.

Software bugs (Safari back button bug still exists, already filed a report with Apple about it), cheap moves on hardware (mainly RAM and storage), going for *the next big thing* (which may end up being a bust) with the Vision Pro.

Being an Apple fan used to be fun. Now it’s about patents, and profit margins, and “what about shareholder value?”. Hey, what about those of us who actually buy Apple products? Do we get a voice in this?

I wonder what happens if you restore the new series 9 watch with a backup from an earlier model that still had this feature enabled, does the new watch somehow disable the app from the old backup?
 
Since the feature isn't a true measure (by a guestimation only). It matters in microcapsule only (meaning not at all)
 
lol too bad for Americans. Works great on my S9 which I’ll be keeping for a few years. I don’t feel bad about missing out on this years Watch lol. Maybe by the time I upgrade Apple will stop being greedy thieves.
 
Hopefully Apple can come up with some permanent solution by the time Series X is released.
 
There will be sellers in the US who will try to get EU versions imported in to the country. I wonder if US customs would confiscate them?
 
This is 80+ year old technology. Apple miniatured it and made it work on your wrist. These patent claims are bullocks.

So if you want money back I assume you already own a S9 or Ultra 2, in which case nothing will change for you - so what exactly are you going to sue Apple for?
If they were going the software route and disabling the feature, is what I meant for current users.
 
As someone mentioned, if this applies to previously sold units, I would think users could demand a full refund and return the watch.
As has been mentioned many times, this doesn't apply to previously sold units.
