And you can get a new iPhone each and every year, even if it isn’t on the exact same day every year. If paying the early upgrade fee is that big a deal to you, you have the option of waiting until November and getting a new phone then. Which would still be this year.

The marketing is clearly designed for folks who want the new model every year. Apple apologists may try and knit the fine details but it's advertised clearly for a certain segment of users who want the newest model every year and are willing to pay for that privilege. Apple did not honor that marketing promise and should compensate those users.

If they dont- some law firm will make a killing forcing them to. As if Apple needs more bad press this year alienating their very best customers.

Apple has done nothing wrong.

The whole point of the program is to let Apple's best customers get the new phones when they come out each year. That's how they marketing it. It's not the "apple finance program" or "apple lease program". If apple wants to take that position, it needs to materially change how it markets the program and who it markets it to.

Like I said myself and many others were never a victim. I sold my 11 pro max at the 12th month and bought a regular iPhone which I returned for a different color and then started the return process on the very last day. By the time my final phone was returned I had the 12 pro max. I repeat not a victim, but people were saying I was victimizing Apple last year. Lol. A guess big corporations can do no wrong.
 
I picked up my 12 Pro Max on November 13th, my birthday. If they charge me 2 extra months, so be it. As much as I hate the phrase: 'it is what is is....'

It’s sad, people like Jeff Bezos and Tim Cook end up paying little to nothing in taxes but when the little guys do similar your ready to lock them up and throw away the keys.

I didn’t do anything illegal, I operated within the parameters of our agreement.

What do they not paying taxes have to do with you abusing the system?
Is what they do okay? Hell NO.
Does that give you a free pass to willingly abuse the system? Absolutely not.

You can hold your old phone for up to 14 days before you send back to apple on trade. Hold til the last day day then send itin. That will take you into October and then you can feel like your not getting ripped off lol🤣. Personally the contract was to make 12 monthly payments to be able to upgrade. The rules were clearly spelled out when you signed up for the program. It’s not sneaky or a scam or false marketing. It’s says you can upgrade your phone every year doesn’t say it has to be guaranteed for launch day.

As I see it both points are valid that, yes, this is fair per the agreement, and yes, this does suck that we end up having to pay a rather large lump sum to upgrade. What this boils down to though is that the iUP was never a good deal and also has a wonky and bad payment structure sometimes. Frankly I’m more upset about the 80-100 in sales tax I have to pay every time on the full price of the phone that I’ll never pay.

I think I’ll exit the iUP. I wanted to save dealing with fb marketplace people but the cost/convenience of this program just sucks. Don’t even get me started on the apple card not working this time.

Good point about the taxes. I think about the tax every year but then I also look at the current trade value of the phone vs what is left. For instance this year the trade value on my 12 Pro 512 was 635 without any of the special carrier options. On my iUP program I have 811 left. The extra month payment this year and extra taxes I pay kinda cancel out the difference between what I owe and the trade value if I paid for the phone in full

I just like the option of having a chance to switch the phone out every year without having to deal with the 3rd party trade in companies. I also like the option that if one year I do not want to upgrade I can just pay the rest of the phone off and it’s covered with Apple care still and then if I want the following year could trade it in for a credit

That's the law in some states, though (e.g. California). Have to pay sales tax on the full, unsubsidized price of the phone.
 
it's a good point- but they should give you a credit for the overpayment of sales tax. i.e. the extra 5% in Ca.

What tax overpayment? You might pay extra for the early upgrade but that amount doesn't include sales tax. The sales tax, you already paid in full upon initial purchase and is based on the MSRP. Doesn't really matter if you keep the phone 11 months or 12 months. You still pay tax for the full 24 months.

Better would be if Apple just switches the program to an actual lease. That way, sales tax can be included with the monthly payments based on the rental amount.

In most cases you pay the sales tax on the full amount of any purchase. When take a loan for new car you pay sales tax on the full amount. If you decide to trade in early and buy a new car you still have to pay the sales tax on the new car as well. I’ve never heard of a car dealership giving back extra sales tax on when you trade in early. Seems pretty standard to me. The IUP is more like a no interest credit card than a loan where charge the full amount and make payments to pay off the the charge.

I think everyone also forgets that IUP is interest free… if you charged the phone to a normal credit card or took out a normal loan you would be paying anywhere from 5% to 20% interest. So I think it kind of balances out in the end. I think IUP is fair and makes things pretty simple when getting a new phone every year

For people who wouldn't normally get AC+ and never has any claims, that's mandatory on IUP so one might consider the AC+ portion as the "interest".

I always get AC+ anyway (for peace of mind and express replacement service) so I usually get IUP to give me options. Granted, I've never really excercised the 12-month trade-in option.

I don’t see it as interest. I see it more as insurance. Kinda like when buy a new car you are required to have insurance as a condition of the loan to help protect the lender

Ah bad luck with the Apple Card. It looks like it's happening to most if not all who tried to purchase with it.
I didn't have any issue that I'm aware of and I ordered 2 phones. Both charges are currently showing pending and scheduled for pickup on Friday.
