It's not a question of whether they have a license or not. OpenStreetMap data is only available under CC BY-SA, and Apple are using it without following the license (since they are not providing attribution). There is literally zero speculation involved.

I have not personally, but many other people have. There is not a hint of attribution to OpenStreetMap to be found anywhere.
