Hmm.....and then the next trial will be Samsung suing Apple for blatantly ripping off their designs with the iPhone X, seriously, look at it compared to the Note 8, the only difference is Apple doesn't have the SPEN.
Apple is rumored to be bringing Apple Pencil support to the iPhone, I think by next year. "Who needs a stylus? " my ass
 
7 years? That'll keep the lawyers in brand new Mercedes for quite some time.
They won't be buying Merc's but Tesla's. Merc's are so last year. Porshe's are even more passe.
And they are made in California.

However, I get the feeling that as time goes by, the chances of Apple actually getting even $1 from Samsung is getting less and less. I'd expect Samsung to appeal even a $1 verdict against them. They seem to be like dog with a juicy bone. They just won't let it go.

I still remember when an expert was testifying at the original trial. She picked up an iPhone to make a point about the design of a particular icon only to discover she had accidentally picked up a Samsung phone. To me, that was the best proof of the similarity.

Are you talking about Susan Kare, a former Apple employee, who supposedly made that confusion during a consultation before Apple lawyers?

Their argument goes into more than just rounded corners. I agree that there were other touchscreen phones out before the iPhone , the LG Prada for instance. However the argument Apple has goes into UI and UX, the skewmorphic design, and some of the details of the device.

While I see both sides, I also see an obvious mimicking of Apple’s design language with the metal bezels, the radius of those rounded corners, the app layout, and even wallpapers. They also (IIRC) uncovered evidence within internal emails (at Samsung) essentially confirming they copied the design.

Like many legal cases, this will set a standard for how industrial design cases are ruled in the future, so, it makes sense for both Samsung and Apple to fight it to the end.

benchmarking your product against your competitors's is fairly common industry practice -- and I'm pretty sure Apple did the same when they decided to make large(r) iPhones, Apple Pencile, or bezel-less display, or other features that Samsung helped popularize. It does not confirm they copied the design.

Show me. I’m 30 and had never seen any device that looked like the first generation iPhone. I only remember them all having physical keyboards.

LG KE850 was announced and released before the first iPhone 2G. Even before then I was using Compaq iPAQ PDA that was the forefather to smartphones.

Let me educate all of you, whom have never patented anything... this case is HUGE!! This case is going to set precedence for many future cases, as Apple had a design Patent! You know when you hear "X Asian country stole our design!!" Most of the time it's referencing a Utility Patent but in this case it's referencing a Design Patent, and while there are other cases won-lost on Design Patents, this is a very serious as to set the tone for what a blatant copy should cost the copier... i.e. SAMSUNG made $500MM not only through the copied product but through ancillary means; product category recognition, accessory sales, brand recognition, alternative product sales, etc. Thus, should SAMSUNG be punished for $500MM or $750MM as to not encourage future copying of someone else's hard work? If SAMSUNG benefits and only pays $100MM, then it's a lose, not only for Apple but ALL OF AMERICA! As you will see company, after company from manufacturing countries take the "What are they going to do, charge me 1/5 of a years profit, tens years afterwards! Hahaha!!!" As far as we Inventors are concerned, Samsung should be responsible for the original nearly billion judgement! Further to this, this process needs to be reduced to Arbitration level of judgement, 12-18 month and you cannot appeal! Most Inventors can't afford to drag on a court case for 2-3 years let along 7!! Shame on this Judge Koh!!

Wonder how this would play out in the courtroom of Judge Rinder, or Judge Judy ..... "You copying sunbitches, pay billions of $ in compensation, case closed" .... all of 10 seconds.
Someone is surely blind if these look similar.

Agreed, I don’t question that, and see that in other industries too.

I work Automotive media freelance from time to time, quite often after a car is unveiled, you will see engineers from competitors looking at materials, taking measurements, and other items at auto shows.

All that said, the internal emails at Samsung, plus the clear design similarities are a little more damaging.

And all came after the 1992 iBM simon, and really old rumors had Apple putting cellular in Newtons before the return of Jobs. In the end, touchscreen phones was the direction the industry was going anyway though.

“... a new trial is required...” to continue to pad Koh’s retirement to ensure proper luxuries in her old age. There can’t be any other reason that this needs to be dragged out even further. At least not if it’s the judge doing this and not the companies, which I’d imagine they are but this is just ridiculous.

Samsung’s entire mobile dominance pretty much began with the iPhone copies. They have build an empire with the help of the iPhone design as proved by the massive strategy guide “How to make our phone look exactly like an iPhone and act like an iPhone” The slide pack said it all


Apple built an Iphone empire on stolen patents while refusing to license technology through FRAND so their lawsuit against Samsung is beyond pathetic.
 
It's frustrating that the damages only ever go down. I was with a lady the other day and she whipped out her Samsung. That UI was essentially identical to an iPhone.

I don’t see any Edge phones on Apple’s radar. Nor does iOS have any features of Touchwiz that I am aware of.

Seriously come on now. If it wasn't for the Note, there would be no Plus sized iPhone. If it wasn't for Samsung making oled screens, wireless charging, and Bezel-less designs popular, the iPhone would still have the same dated design it's had for years. Hell they're even talking about bringing the Apple Pencil to the iPhone, which would pretty much be a complete rip off of Samsung's Note and S-Pen utilization. But of course had the roles been reversed and Samsung did that to Apple, the Apple fans would be hella triggered. Not to mention Apple has blatantly ripped off Android quite a few times. This is the reason why some get irritated with Apple and the company's hypocrisy. Copy off Apple and its off with your head but when Apple does the same thing to another company, it's excuses and hypocrisy by both Apple and it's hardcore fans

That assumes that Apple designed tested and put the iPhone into production in less than a year.

Unlikely, and proven otherwise in this case against samsung. In fact, there have been many prototypes introduced in the Samsung case that predate the Prada release. Including some questionable prototypes that featured an iPod interface. Patents for that were filed in 2006 as well.

That is Samsung's only plausible defense.
 
It's very obvious that Samsung looked at the iPhone and just did their best to copy it exactly.

On the contrary, to anyone with a real design eye, it's obvious that they did their best to look as similar as possible, but without exactly copying anything that they would consider patentable.

(Not sure why anyone says "exactly the same". It's like saying a Ford Fusion front looks "exactly" like an Aston Martin front. Very similar grille, yes. But exactly the same? Nope. Ditto for the Galaxy vs iPhone. Really close in places, but not exact.)

... AND Samsung had a whole strategy guide written up to copy the iPhone. That’s the point.

That Galaxy UI review document explicitly noted at the end that Samsung should strive to NOT look like the iPhone. Plus most of its recommendations were never used, or were not iPhone specific. Most people haven't read it.

The case has already has set a precedent, in that the Supreme Court ruled once and for all that infringing a design patent does not automatically convey full profits as an award, as Judge Koh had mistakenly instructed the jurors.

You need to look into Design Patents, as that is what this case is revolving around... Apple was granted a full Design Patent, that Samsung blatantly copied!

On the contrary, Apple didn't use their "full" iPhone or iPad design patents, because Samsung could not have infringed them without also having items like a round Home button and exact shape.

Instead, Apple used their generic rounded rectangle and flat screen design patents. And yes, the so-called "colorful icon grid" patent, which was likely the real killer to anyone who's never seen rounded icons or a application dock.

A true retrial should be interesting because perhaps this time Samsung's lawyers will get to introduce the prior art that Apple's lawyers made sure was not seen by the first jury... an omission that was key to convincing the jury that Apple had actually been first at any particular design element. E.g. the jury never saw the 2005 Pidion, which many people think had an effect on Apple's design:

The message is clear, copy and make profit. After 9 years you will be able to pay the lawsuit and make a profit in the end.
