What Apple products does Samsung have a hand in making? :rolleyes:

Macbooks, iPads, iPhones, iPods... name it, it has Samsung semi-conductors in it.

Not theft? Lol. You have to go no further than Samsungs rip of Apple's packaging, and their knock off on the smart covers ...

All of which are either trade dress, trademark or patent infringement (except the smart covers, those aren't made by Samsung, thus not at issue in this discussion).

Infringement of IP is not theft. For theft to occur, the original party must be deprived of their property, something that IP infringement does not cause. Samsung or Apple or IBM or Novell or Microsoft using a bit of IP that belongs to another company does not prevent nor deprive said company from using that same bit of IP.

Maybe some of that research you're proposing would do some good here. Might want to actually understand the issues at stake here so we can have an intelligent discussion.

BTW, this is not about packaing, cases, covers or any other visual cues or IP. This is about touchscreens and gestures, and until we know the patents, we cannot know exactly what the Australian judge finds that was infringed. Don't forget the Dutch ruling where a single patent was found in infringement and the ban will be lifted since Samsung fixed the issue now.

Not to mention that if you buy a TV made by Sony, LG or another non-Samsung manufacturer, chances are, the LCD panel in it is made by Samsung. Good luck with that boycott. Might as well throw your worldy possessions away and go live on a deserted island if you want to boycott Samsung. But you'll have to swim there because I bet they make some of the components in many boats and ships.

I could agree with this. I posted those images because people keep circulating a different set of images to prove their point, these images prove mine and so images in themselves are useless when dealing with 'look and feel' patents (the validity of such patents in my opinion is in question).

Australian judges tend to jump between awesome and *******s (I'm an Australian, I'm allowed to make such generalisations). On the one hand we awesomeness, such as judges ruling the Internet Service Providers are NOT responsible for enforcing the film industries copyrights, and preventing a young girl from leaving the country to stop her parents putting her into an arranged marriage... on the other hand there's been a couple of weird decisions. If this patent decision is in regards to decent patents, then I'd have no choice but to accept their decision (I'll have to accept it anyways, but you get my meaning), but if they're banned for something as stupid as in Europe, with the photo switching gestures, then I'd be greatly annoyed....
 
I have to say that as much as I love Apple products and use them, there is a need to have other choices. I bought an iPad when the first gen was just released and it is a great device. I was playing around with other tablets at BB and it took awhile for anything really decent to come out. The Galaxy 10.1 was the first tablet that really impressed me. :cool: Android is a viable competitor and Apple knows it.

After trying out a couple of 7" tablets in the store, I realized that the form factor was ideal for a lot of what I need. Apple pretty much made it clear that they had no intentions of making a smaller tablet so I decided to give a 7" android a try. I like the smaller size a lot and it's an area that Apple isn't competing in at this time. When the HTC Flyer was dropped down to $299 at BB, I nabbed one. It is the same price as a 32gb touch but more enjoyable to use for reading, surfing, etc. If this size tablet takes off, I wonder if Apple will decide that they want that market as well? :rolleyes:

The competition is starting to get fierce so Apple is pulling out all the stops. They make great products, but the arrogance has gotten to be a bit much.

Certain things are going to have basic designs. The basic designs that define a class of product should not be protected.

If the same legal atmosphere existed 100-150 years ago what would the world look like?

One brand of car. "Our car has an engine and four wheels. You can't sell something that has the same thing.

How about one brand of ice cream?
One brand of shoes?
One brand of clothes?
One brand of deodorant?
 
It's stuff like this that has stopped me from buying Apple products.

When I bought my Powerbook G3 Apple used to be a good professional brand.

Now they're just a company that sells overpriced consumer stuff to fanboys and people who spend too much money on computers.

I wish the old apple would come back.

The old Apple was overpriced. I paid $10,500 for my 512K Apple III with a 12" yellow-screen monitor and 5MB hard drive. Current Apple proces are fair considering their equipment "just works". I.T. needs to fix my PC at work nearly daily to keep it going.

Fair enough. I'd like to add that I'm not some Samsung fanboy, I'd just prefer if all products were allowed to sell rather than being banned. If Apple's devices are as good as they say, they should need to seek injunctions.

Would you feel the same way if you send years and millions on R&D than have someone come in and COPY your product. Would you call that fair business.

Make an app or edit a movie from an iPad to the quality one could achieve on a computer and then I'll accept your point.

Maybe its just me, but I could make a case that a well scripted, acted and directed film created on an iPhone(s) and edited on an iPad would in total be a better film than some of the features that the industry heavily postprocesses on PC's and workstations.

Your point is taken in its context, all else being equal, but too many times, all else isn't equal.

There have been and will continue to be great films created with simple tools, like iPhones and iPads.

Wow... Apple is playing so dirty. Using an injunction to deliberately delay the Galaxy so they can't sell during the holiday season. So dirty. All the people who can't see why its dirty need to realize that an initial injunction is easy to get. All it takes is enough proof that the allegation could, not that it is, be true. Then while Samsung is fighting Apple in court which will take months if not longer, the injunction will stay in place, crippling Samsung, because gadgets have very short shelf-lives. Even if Samsung wins the case later down the line, the damage will already be done.

You are aware that if Apple loses, there would then have to be a judgement of damages assessed that apple would have to pay, including all legal fees of Samsung?

Apple got a patent for a minimalistic tablet design, just a rectangle with screen in the middle, without the home button. It was deemed different enough for a patent. So they do hold a patent. But they should not, because its just minimal and not innovative. Again, let me repeat that patent laws are there to protect innovation and creativity. Nothing innovative, and creative, about a rectangle.

Funny that, but Apple happened to ship a minimalist design that created a pivot in the tablet market so radical that every other manufacturer had to go back to the drawing board, and in Samsung's case, the result was quite a bit too close the the iPad, hence the Trade Dress injunction in Germany.
