Really good point. And, most likely if they come with a watch, Apple will use their war chest to counter as a ploy to negotiate terms. The problem with patents, everyone infringes on them. Meaning, they probably are both infringes on each others patents some how.To those saying "just buy them", Masimo's current market cap is USD 6 billion and Apple would have to pay a multi-billion premium over that. The company's products are also exclusively commercial in nature and are used in hospitals and other medical facilities (though they are preparing to enter the consumer market with a smartwatch).

The problem is any "fix" will likely be bundled with other bug fixes, new software features and security patches. Electing to never upgrade your watch doesn't seem like a viable long-term solution either.Just don't install any automatic upgrades.
What about people who aren’t obese? I’m a gym rat and unfortunately developed it after gaining lots of muscle.Oh of course, that was just about the only example I can think of.
My brother is a pulmonologist/critical care doc, and he does sleep medicine as well. In his experience, barring the rare congenital anatomic based obstructions in airway, nearly all of his sleep apnea patients are obese -> morbidly obese. And in nearly every case, once the weight is gone, people begin breathing more naturally, through their nose, and the apnea resolves. Intellectual property of others apparently 😂Change the algorithms and patented methods used to avoid patent infringement. Apple will do everything it can to keep selling the Apple Watch, after investing so much in the product's intellectual property over the years.
