We can thank the idiots who were transferring dozens of gigs a months on their unlimited plans for this throttling. I highly doubt ATT would even have cared to implement something like this if people hadn't been tethering as their home internet connection saying "I paid for this data I will use it how I want". No, no you won't. In fact, things were made much worse for the rest of us.
I agree. Things like this have always had an implicit caveat: "within reason." People didn't want to hear that and just kept parroting "unlimited" as if it was a birthright. Well now it is coming to and end. Somehow I think they will manage.

But by far the worst of the worst were those whose mentality was: "I paid for unlimited 3G, damned if I was going to use WiFi!"

You can not have a contract that says you can change the contract at any time you want. Well you can but it won't hold up in court. Now if they said it has an option if you go over so much in so much time that will work. However that is not in the contract.
You are confusing TOS and contracts. You don't have to be on a contract: the TOS applies to all. If you don't like the TOS then you should be getting service elsewhere. Don't expect not to see a very similar TOS on any other carrier though.

In this case the contract's primary purpose is not to define service. It is to ensure you stay around long enough for the carrier to recoup any subsidies given to you.

well I got so frustrated at my slow speed that I had to contact at&t and get on data pro 4GB :( no more unlimited :(

You keep throwing this court thing around this and other threads. You seem incredibly sure of yourself. Why don't you take this to court? This is a serious question. You stand to win boatloads of cash as well as the support of many people across the nation (who will likely start tossing money at you in praise as well).

I actually already have something going on in that department, and I can only take one at a time.

I am not against AT&T, I am pro rights. I don't know why we keep bumping heads, I am just saying stand up for what you think is right and within your rights. When you sign a contract keep it, and make the other party stand to it. Many people and corporations especially will push you around because most people won't stand up for their rights.

Instead of telling me what to do, why don't you try to educate those around you? That's all I am doing, I'm sorry if that offends you.

You don't offend me in the least. And I am not trying to tell you to do anything, I was merely questioning why you don't do anything if you are so sure of yourself. It is just a serious and legitimate question I had. You have stated many times that none of this will hold up in court. It's just strange to me that nobody is slamming AT&T in the court if it "will never hold up".

You state you are just educating people. Your educating seems to be comprised of statement like "ATT can't do this" and little more. Who, exactly, do you claim to be educating? I would think that it would take just a little more information than that to get the average guy on board with your ideas, but who knows. After all, this is the internet.

If you are saying you started a case with ATT, great! I'd love to hear the results of the court-case and sincerely wish you the best. If it is as cut and dry as you claim, you shouldn't have to wait very long at all for a ruling in your favor.

Thanks for the offer, but I feel this does pertain to the topic. If all you want to talk about is ATT throtting you specifically, you need go no further than the title of the thread. It has within it everything you need to know. "ATT is indeed starting to throttle people once they go over 2GB used for the month". We are discussing whether they are within the right to do so, and why, or why not.

No worries. It's sir, and I wouldn't have gotten upset about that anyway. Personally, I like a good debate when each party brings good points to the table.

Frankly, if this does go to court, neither your opinion, my opinion or anyone else's opinion should matter. Court cases should always be settled on fact alone. My opinion is that it is unacceptable that AT&T is throttling people. Whether they are in their legal rights to do so? I am leaning towards yes. Does that make it ok? No, but the way to show disdain is to leave the company and drop their services entirely.
 
Collectively, we need to work together to find a loophole such as the Unlimited Data loops.

I have several ideas outside the box, will test them this weekend. If we can get unlimited data, I'm sure we can find a way to get pass a throttle.

this was me for awhile. however i still use 10k-15k a month in minutes..... thank god they dont throttle those.

i havnt been using iphone as much clearly. but never once got slowed down.
 
Unfortunately for a few of us, we have been singled out and selected to be throttled at unreasonable speeds.

No confirmed threshold. No consistency. No information.

But it would be nice for ATT to clarify the information, so we could avoid being throttled 5 days into a billing cycle :)

Anyway, It seems that they're throttling based on how much you use in a certain time frame. Like for me, my billing cycle is on the 7th of every month and in a week I used 2GB, which would roughly put me at 8GB at by next billing cycle.

So perhaps if we spread our usage out we wouldn't get throttled? Just a thought.

Some are getting throttled late in the billing cycle just past 2gb.

It's completely inconsistent, doesn't matter where you're located, how much you have used prior, current rate of usage, type of phone, fan account or not, account age, and even in my case, throttled me 3 days before I received the Top 5% msg. Go figure.
