this was me for awhile. however i still use 10k-15k a month in minutes..... thank god they dont throttle those

15k minutes per month?!

Lets do the math:
- 15,000 divided by 60 min = 250 hours
- 250 hours divided by 4 weeks in a month = 62.5 hours per week
- 62.5 hours a week divided by 7 days a week = 8.9 hours per day

You're on the phone for 9 hours a day? Good lord man go get checked out for a brain tumor from the amount of radio waves your getting! ;)

gf use to make me keep phone at night, while we slept, etc... towers called me directly and asked me wtf is going on with my phone because im airing out inhumane amounts of hours etc, private tower being used by att, we roam on it, and they got very upset that we would use thatmany a month. why? i dunno..

So, I did some calculations today and AT&T throttled us by 96%. That's a little ridiculous don't they think.
I might call them today.

...I think you need to have a serious discussion with your gf. At the very least just play the whole "if you love me then you won't want me to get a brain tumor" card. While it's true that studies haven't shown a significant link between cell phone use and brain tumors, none of those studies assumed 9+ hours a day of constant usage.

And if you're roaming that much, you should be careful. AT&T can (and often does) drop customers for roaming more than 50% of the time. They're within their rights to do so (it's in the contract).

I also can confirm this throttling. I'm at about 3 gb right now and the last couple of days I noticed my sportscore app was loading slightly slower than usual. For kicks I opened up my speedtest app and did a couple of run. What I received was a shocker. I was getting only 0.20-0.50 mbps as where in the same area I was use to getting anywhere between 3.0 - 4.0 mbps. First I thought something was wrong with my phone so I reset all networks and then thought maybe my Vapor Pro case was hindering performance so I took that off also. Still the same results....then just to make sure I grabbed my wife's 4S and did the test and hers was getting the usual 3.0-4.0 mbps speed. She only used less than 1 gb so far so she's safe I guess. Then just for the heck of it I transferred her sim into my phoneand what a surprise....the speed went back up to 3.0-4.0 mbps. So now I finally concluded that nothing was wrong with my phone but I am being throttled.....which sucks and should be illegal.

I too have been getting these texts about my data usage. I go and use my phone today and everything internet related is super slow. I tried resetting the phone, putting it on airplane mode, closing my apps, nothing. I officially hate ATT now.

They throttled you. Dial *3282# to find out how much data you've used/where they throttled you at.

do a speed test with the speedtest.net app and report back.

thanks.

it says 2320.2 of unlimited data in MB and 56 of unlimited for messaging.

What does that even mean?

That means you've used 2.3GB of data and you've sent/received 56 texts (all of that is in the current billing cycle)

OK I have been going back and forth with ATT about another issue. Two months ago they raised the rate that they charge us for a government fee. It went from .66 cents to .70 cents. Well it ends up that that can be enough to get you out of your contract with no ETF as long as it has a "Materially Adverse effect" on you per you.. Now while I say that, its a big trouble to get them to do it. I have showed the reps on the phone, level two reps in the quiting department (forgot the name). That the fee is charged to ATT not to us. Here are some snipets from the contract.

http://www.wireless.att.com/learn/articles-resources/wireless-terms.jsp

1.3 Can AT&T Change My Terms And Rates?
We may change any terms, conditions, rates, fees, expenses, or charges regarding your Services at any time. We will provide you with notice of material changes (other than changes to governmental fees, proportional charges for governmental mandates, roaming rates or administrative charges) either in your monthly bill or separately. You understand and agree that State and Federal Universal Service Fees and other governmentally imposed fees, whether or not assessed directly upon you, may be increased based upon the government's or our calculations.

IF WE INCREASE THE PRICE OF ANY OF THE SERVICES TO WHICH YOU SUBSCRIBE, BEYOND THE LIMITS SET FORTH IN YOUR CUSTOMER SERVICE SUMMARY, OR IF WE MATERIALLY DECREASE THE GEOGRAPHICAL AREA IN WHICH YOUR AIRTIME RATE APPLIES (OTHER THAN A TEMPORARY DECREASE FOR REPAIRS OR MAINTENANCE), WE'LL DISCLOSE THE CHANGE AT LEAST ONE BILLING CYCLE IN ADVANCE (EITHER THROUGH A NOTICE WITH YOUR BILL, A TEXT MESSAGE TO YOUR DEVICE, OR OTHERWISE), AND YOU MAY TERMINATE THIS AGREEMENT WITHOUT PAYING AN EARLY TERMINATION FEE OR RETURNING OR PAYING FOR ANY PROMOTIONAL ITEMS, PROVIDED YOUR NOTICE OF TERMINATION IS DELIVERED TO US WITHIN THIRTY (30) DAYS AFTER THE FIRST BILL REFLECTING THE CHANGE

Ok they will try to get you to believe that means that you agree that there is nothing you can do about the fee. but that is wrong.

What that says is that the you agree the government can raise their fees to ATT at any time and theirs nothing you can do about it. Well thats true, they can, but that doesnt mean ATT can charge you more anytime just because the fee has been raised to them. You see in another part of their site it states this about the "fees"

http://www.wireless.att.com/cell-phone-service/additionalcharges/

Additional Charges

Regulatory Cost Recovery Charge
The Regulatory Cost Recovery Charge is a charge assessed by AT&T associated with payment of government imposed fees and to recover the costs of compliance with government imposed regulatory requirements. It may include costs incurred in prior years that are not yet fully recovered. It is not a tax or charge which the government requires AT&T to collect from its customers. This charge is subject to change from time to time as the cost of compliance changes.

So right their they admit that what they "Charge" the customer is a "Charge" not a fee, its a "charge" designed to recoup the fee from the customer. Here is some more this one is on your bill

General Information
Late fee: Accounts with former AT&T Wireless plans are charged 1.5% or less of the balance unpaid as of the next bill period. Accounts with Cingular/new AT&T plans are charged $5 in CT, DC,DE,IL,KS,MA,MD,ME,MI,MO,NH,NJ,NY,PA,OK,OH,RI,VA,VT,WI,WV; or 1.5% of the balance unpaid as of the next bill period in all other states. Accounts with former AT&T Wireless and Cingular/new AT&T plans incur the lesser of these charges.

or call 1-800-649-7570 or TDD 1-800-229-6846.

AT&T surcharges include: Regulatory Cost Recovery Charge to recover costs to comply with government assessments and regulations; Universal Service Charges; and gross receipts charges.

Then in their own words again, but they break it up so I will do some editing to make it easier to read. From section 1.3 of the wireless terms.

IF WE INCREASE THE PRICE OF ANY OF THE SERVICES TO WHICH YOU SUBSCRIBE, BEYOND THE LIMITS SET FORTH IN YOUR CUSTOMER SERVICE SUMMARY, OR IF WE MATERIALLY DECREASE THE GEOGRAPHICAL AREA IN WHICH YOUR AIRTIME RATE APPLIES (OTHER THAN A TEMPORARY DECREASE FOR REPAIRS OR MAINTENANCE), WE'LL DISCLOSE THE CHANGE AT LEAST ONE BILLING CYCLE IN ADVANCE (EITHER THROUGH A NOTICE WITH YOUR BILL, A TEXT MESSAGE TO YOUR DEVICE, OR OTHERWISE), AND YOU MAY TERMINATE THIS AGREEMENT WITHOUT PAYING AN EARLY TERMINATION FEE OR RETURNING OR PAYING FOR ANY PROMOTIONAL ITEMS, PROVIDED YOUR NOTICE OF TERMINATION IS DELIVERED TO US WITHIN THIRTY (30) DAYS AFTER THE FIRST BILL REFLECTING THE CHANGE.

Now why am I bringing this into this thread. Because I believe that when they send you that Text, you can call and state that because they are changing your service you want out of your contract with no ETF. Now the question is does it have a "Materially Adverse Effect" on you per you under the law? That is a valid question.

And to answer your question about what going on with my little thing. At the end they agree that the contract says that I can get out, however I have to send the arbitration letter to the CFO as desribed in the contract (I didnt paist its to long) so they dont even follow their own contract without a fight.

Sir, I just looked on verizon's website and they are not offering unlimited data for the Galaxy Nexus or any other smartphone.

Like I said, they don't offer it. But you can get it. :)

Check your pm.

Just got throttled again this month... 4.4GB used.

Last month it was ~10GB before throttling

The month before that was ~12GB before throttling...

AT&T sucks.

As people continue to leave, get throttled, and basically use less data, expect the throttling to to start earlier and earlier until it settles around 1.5GB.

I've filed a FCC complaint against AT&T.

It doesn't seem reasonable for "unlimited" data when I can't even use the amount that's provided. And in no wording in my contract that I would be limited or throttled if at any certain amount. Furthermore, before learning the announcement from MacRumors, AT&T has never contacted or sent a letter stating that they were even performing throttling starting October 1, 2011.

As much as you guys would argue that network capacity is a limited resource, it is not fair if you paid for unlimited usage and say, hey, well, you might have unlimited, but you can only use 4.4GB.

If I was abusing the network, aka, tethering, then I have no saying. On legit use, Netflix (if you don't allow streaming, don't allow the app.), Pandora, etc. I should be allowed to use what I'm paying for.

...and AT&T will simply say that they made numerous postings about it on their website, to all the major news outlets, and, most likely, sent a flier (buried amongst everything else) back in July notifying people of the change.

Raising a fit about something 5 months after they announced the change probably won't get you very far.

The problem I see here is that you DO still have unlimited data. Incredibly slow data, but unlimited data nonetheless. I think AT&T can *get* you there.

I do hate this though. I'm on unlimited data and use between 3-4 GB a month with no word from AT&T as of yet.

I don't think that will do anything.

You still have unlimited data. You are not guaranteed any specific speed.

AT&T has basically slowed it down to EDGE speeds. In many areas of the country you can only get EDGE so arguing about that is not likely going to work.

This was also the only speed available when they first offered the iPhone's unlimited data plan.

They also can simply stop offering unlimited. The grandfathering was a good-will gesture, not a legal requirement.

Michael

I did Call AT&T customer care and they told me they also view your past data usage. I.E. If you had a really high data month then the next month you'd be throttled at a low amount of data used. It seems that they're discriminating against us.

My question is, how can a person with a tiered plan use as much data as hey want (assuming they pay for overages) while an unlimited plan gets throttled.

That seems to be the case... coupled with how non-smartphones are not throttled regardless of how much data they use, this proved that this is strictly about profit and not network congestion.

Then that's discrimination. Which is actually illegal. Maybe we should threaten them with that?
