With the millions of iPhones being made, it is very probable that there are going to be a few phones with defects straight from the factory. This isn't unique to Apple.
 
Apple's QC has gone down a lot, and allegedly they are trying to do something about it.

It's ridiculous that people insist Apple can do no wrong. If you're mass producing a device you'll always get some duds no matter who you are and some of these products are bound to slip thru any QC process.

Exactly. A replacement (white box) I received from Apple via FedEx had the loose battery issue, same as the OP. And supposedly they go over those with a fine tooth comb. Things happen, sure. But the iPhone 5 seems to have more issues than most.
 
If nothing else is wrong with the phone, fix the loose battery yourself. All you need is a pentalobe screwdriver, some tape, and about 15 minutes.

I've seen a ton of defective one's...On both the black and white versions

From Scratches on the aluminum back, dings, scratches and nicks on the chamfered edges, to what the OP is stating which is more then likely the battery inside coming loose from the adhesive or whatever is holding it in place.

Honestly Apple's quality control is down right terrible at this moment in time. And this is coming from someone who has owned a slew of Apple products over the last 7 or 8 years ranging from computers, ipods, ipads, and pretty much all the iphones...They really need to get they're act together!

I would prefer to not have to fix a brand new item out of the box; I would expect an exchange. But thats just me.
 
I can tell you from experience that when the ip5 came out initially it was bad dents scratches etc. Now understand not everyone experienced this, but quite a few did including my self. I recently picked up a new black one about a month ago and I can tell you now QC is far better !!!! Last two phones I have had have been physically perfect, only issue I'm having is with software on my end.

Really? The 5 five I when thought were scratched and chipped out of the box
 
UPDATE: So I couldn't stand the Note 2, as its just way too big. Thought I liked it at first, but I guess I was wrong. I picked up another iPhone 5 and this one seems fine.

My only question to some of the experts on here is, is it normal for the screen to be a tad yellow? I see the phone was literally produced 2 weeks ago.
 
Defective iphone5 seems to be rare. Surely there are some but in proportion to the number made it really nothing.
 
I don't know if the latest iPhone is any harder to make or fragile than previous models, as of online complaints it's well known that people are 10 times more likely to complain something is not working rather than report all is well with their new product.

Sometimes problems happen, if nothing broke we wouldn't need warranties and it's the reason people get AppleCare. It could have been bumped during shipping or just a production problem. I'd get a replacement and move on, if that one has a problem then you have cause to complain further.
