Moral issues aside, OP made a business decision, a gamble, a calculated risk if you will, to sell his machine early knowing full well that he would be without a machine until the new one arrived. New work coming in and no machine to do it seems entirely his own fault.
If Apple's return policy rules allow him to buy a machine, use it, then return it, he is still complying with the "letter of the law" so to speak. Just not with the spirit of the law.
That said, I'm guessing there is a restocking fee, which likely negates the improved sale price of selling his old machine early. Cest la vie.
