Defendants’ Solo Wallet Case and Pretty Sweet Solo Wallet Case products are exemplary. The copying is so pervasive, that the defendants’ products appear to be Callet World products with the same rectangular shape with rounded corners

So, they're suing them for making an iPhone case that's shaped like an iPhone?

Callet doesn't even sell a case for the iPhone 5, and Hex only sells an iPhone 5 case. Hex is filling an ecological niche Callet chose not to fill.

They should both be prosecuted for being rubbish.
 
It may infringe a patent, and an idea that someone took considerable time/risk/money to make real. I don't know.

But "slavish" it is not. It's similar at most. The general principle has probably been thought up many times. (And it's a pretty bad one... nothing would make me feel safe with my cards sticking out like that!)

I'd think that the problem is primarily the lawyer's client. As a lawyer, you would explain to your client what their options are, and what their chances are of winning. It's then up to the client to decide what to do. Personally, I think if you held up both in front of a Samsung lawyer, he would see the difference.
 
IMHO, the Callet wallet-case design appears to be inferior to Hex's design as far as aesthetics go.

Plus, I've seen other cases do the exact same thing and Callet isn't complaining about them.

At any rate, if any of you are interest in a wallet-case since we're on the subject, I just got a BookBook recently and I love it :)
 
Having looked at the photos and the design patent: The shape in the design patent is to my old eyes quite distinctly different. The design patent actually matches to my eyes the shape of the Galaxy S3 phone quite well, which is quite a different shape from an iPhone (unlike older Galaxy phones). The shapes of the products are much more similar, both "iPhone shaped" as you would expect from an iPhone case. But it doesn't matter how similar the products are, what matters is the similarity to the design patent.

Seriously? This is an iPhone case, every single one has rounded corners.

They are just mad because Hex made a better looking design.

Well, the whole thing is ridiculous. The article states they're suing Apple for *selling* the product. Not anything to do with its design or manufacture. So I imagine it all went down like this...

1. "Hey Apple, you're selling this product that infringes on our patents, please cease and decist."
2. Apple does not acknowledge, continues selling said product.
3. In the eyes of the sue-er, Apple is now knowingly selling a product that infringes on their patent.
4. Sue.
 
Obviously sue Apple because if they hadn't made the iPhone, there would be no claim because Hex wouldn't be copying the design, because there wouldn't be a design to copy...

Perhaps Apple's corporate team should sue Callet because they want Apple to 'own' their part of the fault for creating the iPhone in the first place, and giving Callet the impression that it 'owns' all iPhone cases with a credit card sized slot.

In that case Apple's legal team just needs to find all of the other locations and websites where that case is sold, and urge that Callet sue ALL of them, or drop Apple from the case. There is NOTHING contributory to the 'crime' that Apple alone has done, unless Apple is the only one selling this case. DUH!
