I'm banking on the fact that although I have no iPhone, I also have NO data OR texting plan... which means they stand to make at least $700 off of me if I upgrade (on data alone).

No there really wasn't any confusion. Original iPhone owners have always been able to upgrade to the iPhone 3G for 199/299 dollars. The confusion is whether or not current non-iPhone AT&T consumers can get that price.

For some people the confusion was whether or not they were going to take into account subsidized phones purchased before the iPhone. For example, I bought a Curve in May, then saw the iPhone, loved it, bought it in June. They were basing my upgrade eligibility off the May purchase, which would make sense, but even then, mine was updated to say I can get the new one.

Same here, signed up for the plan in March, got a 'free' phone, then bought the refurb iPhone a week later. ATT website says I'm eligible for the 3G iPhone!

How do I check to see if I'm able to upgrade?
-----

Got to ATT website and login you account and see upgrade options.

I just tried to log on to AT&T and it seems to be down. Tried on Safari (default browser) and since some sites don't work well on Safari (like OldNavy), I tried Firefux (pun intended) and still nothing. Anyone else having issues?

Update:

Nevermind. I got in. And had quite a shock. Under the 'Phone/Device' section, it changed from my iPhone (which I sold a week ago) to the RAZR that I'm currently using! I had no idea they'd realize I switched. At any rate, it said I was eligible, most likely because I had and currently have the iPhone plan, which is what really matters.

YES! For those of you who sold your iPhone, I wouldn't change the plan if possible until after the 11th if you want a 3G version.

Sooooooooo another update:

Just logged on again, and my device changed from the RAZR that I am currently using to the Sony Ericsson T226 that I had to use for a few days before I found my RAZR.

THEN!!!

The AT&T website went down. Says "The server you are attempting to contact is temporarily unavailable. Please try again later. We apologize for the inconvenience."

Last month the website said I was able to upgrade on 6/9/08, now it says i'll be able to upgrade on 9/9/08...

Edit:
I currently do NOT have an iPhone plan, but I do have a 3G Dataplan for my Windoze smartphone
I have not had an iphone pan
My last upgrade was Jan of 2007

Last time I checked, mine had said that I would be eligible on 2/29/2009 or some such, but now it says I am eligible for an upgrade.

1. iPhone Plan purchased w/ 8Gb iPhone on 6/29/2007 - Not using an iPhone currently, using an unlocked T-Mobile phone with my ATT sim.
2. Still have my iPhone plan, haven't made any changes
3. Have not used an "upgrade"

1. Yes, both me and my wife have iPhones and iPhone plans
2. Refer back to #1
3. We just signed up for AT&T back in May and both got BB Curves from Radioshack for $50 a piece. We weren't elgible prior to today and now both of our lines are elgible.

1. iPhone plan without iPhone, sold it before WWDC.
2. Plan has not changed, still paying for iPhone plan.
3. Bought an 8525 in May prior to iPhone release, but bought an iPhone on release day so upgrade eligibility was out the window until this morning.

Hope that helps.

1. I have no iPhone, but do have an iPhone Plan (currently using an old razr)
2. I am upgrade eligible - verified by phone
3. I have not used an upgrade in the last 18 months

Yeap!

My wife & I are both eligible to upgrade our iPhones, she bought hers in Dec 07 and I bought mine a few months ago. :)

Has anyone else been checking their upgrade status?
I am currently on an iPhone plan. Yesterday it said I was not eligible for an upgrade. As of today my upgrade status changed to eligible for upgrade.

I checked my dad's upgrade status and it said:

You can take advantage of our no-commitment pricing option. This line may be eligible for an equipment discount on 10/09/2009 More Details

does this mean that he can't upgrade to the new iPhone when it comes out? (He just has a basic samsung slider.)

This is awesome! I got a crap phone with my iphone back in February. It said I wasn't eligible for a new phone until 9/09 last time I checked. Now, I am currently eligible.

1. I have an iPhone with an iPhone plan.
2. I have never changed plans with AT&T
3. I purchased a knock-around nokia with my original 8GB iPhone in Feb but upgraded to a 16GB in May.
