Same can be said for Apple not updating iPhone 4 to iOS 9? Is Apple neglecting to path major vulnerabilities? At least with Android, you have option to flash custom ROM with updates? Can you do that with iPhone?

My Moto G 2014 have not receive marshmallow update yet, but I flashed CM 13 with Android 6.0.1. Can you flash iOS 9 to iPhone 4? Nope, too bad, you should upgrade to iPhone 6S. With Android, I always have option to flash latest custom ROM.
This is different. Moto G 2014's hardware is capable of running Marshmallow even though it didn't receive the update yet. The iPhone 4 too old. If iPhone 4S has difficulties running newer software due to hardware limitations, the 4 would likely not even be able to run it at all.
Try finding a older budget phone like .. . a Samsung Conquer 4G. Look at the specs and decide if flashing a custom ROM would work.
 
Apple should have a check when they try to install it and display a message that the phone is not supported. They do it with old Macs. Why ruin the iOS experience for people and have them get upset after the upgrade?
 
Not downgrade but you can pop in a Win7 DVD and do a fresh install. I should be able to fresh install iOS 8 on my 5S if I want to, but that is not allowed. Apple is big enough that they should be supporting a couple of releases of iOS with security patches. They do this for Mac OS without issue.
Hmm...I'm not sure why anyone would want to install iOS 8 over iOS 9 on any device. I get the argument and I'm not totally against it but I don't see where a court has the right to force Apple to do this.
 
On one hand this lawsuit is stupid.

On other - Apple broke face time and would not fix it unless you upgraded the iOS and deal with the degradation. I think their policy of forced software upgrades therefore deserve some negative publicity. They don't optimize well new iOS for old devices and make them very poor experiences. I have an old 4S and an iPad mini and both are horrible when updated. Shame on Apple for that.

Plus the fact that Apple gets a big marketing push out of claiming that "9x?% of all active devices on the latest OS". Too bad the experience sucks. We have both a 4s and iPad 2 that now suck, but are both fully updated. One reason we quit buying Apple devices and quit updating. We used to buy new devices every 3 years for computers and every 2 years for phones. We did it because we wanted to, but we are not going to do it when we are being forced to.
 
apple got greedy, should be punished! the 4s is 4 years old purchased on day zero, I assume most people bought it lets say 3 years ago.. this is the worst lifespan of a product in all apple history!

everybody understands that this is a great way to boost new iPhone sales simply by crippling all 4s's. its totally unacceptable

Now THIS will be a story worth following. Will be looking forward to Apples response in court.

Apple could be found guilty of false advertising, it doesn't state anywhere that your device will run like poo after updating, and it also does NOT state you will not be able to roll back after 2 day's of the release of the new update.

Not going to the court. This is going to be dismissed just like the old ones.

In other news in an alternate reality, Apple is sued because it didn't put IOS 9 on iPhone 4S (A5) even though it was put on the Touch 5 (A5) and iPad mini (A5), :D.

Wow the comments on this article are insane. The plaintiff has a case if they can find a way to compare the performance before and after updating.

Using that criteria, we would never upgrade :D. The performance is almost always worse after any type of upgrade (you are trading performance for new functionality).

The plaintiff have no case unless they prove Apple purposely hurt the performance in order to sell more phones.

Because you are licensed to use their software on your device on their terms. Period.

You don't own iOS. Apple does.

not much different. There are marshmallow based ROM for Galaxy Nexus. Galaxy Nexus came out just few months behind iPhone 4S. As how well it runs, I don't know. I don't have Galaxy Nexus, but I can tell you that nexus 4 runs marshmallow perfectly.

Then let's going back to the core of the question: If users can sue Android OEMs not provide securities patches, then clearly Apple users can sue Apple not providing update for iPhoen 4.

And, you really don't need security update for Android, as lots of stuff can go through Play Store.

My rule of thumb is to only upgrade my iOS on my iPad, iPhone or iPod within 2 years after its new. Any updates after 2 yrs I find there are issues. This extends the enjoyment and functionality of my devices greatly. Otherwise I get frustrated with the performance and play right into Apples plan of continuously getting new devices.
 
What a joke. As if Craig Federighi tells his engineers to insert code that will intentionally slow down older devices. People sue for anything and everything these days. Only in America. :rolleyes:

This is an extremely stupid case IMO. No where does Apple guarantee any performance, and I'm sure those terms of services has Apple covered.

Hmmmmmm I wonder if I could sue Apple because El Capitan will not run on my Mac Plus.

Anyone with an ounce of brains knows that the older the device the likelihood it will have difficulties with the newer operating systems. Apple is in business to sell new iPhones. If you are still using an iPhone 4S, I'm sorry babe but that phone needs to go. YOU are the one responsible for making the decision to upgrade the operating system, not Apple. Apple does not force you to iOS 9 on your 4S, that was YOUR choice. the latest operating system is designed to run on the latest technology, not one that is at least 4 years old. Grow up and get a life.

Yeah, no one physically force you upgrade. But when you need do service at Apple store, when your iOS 6 no longer functioning correctly or when you need to do DFU reset, users will have no option but upgrade. If this isn't forced upgrade, then what is?
