Your logic makes no sense. If you upgrade to an OS and discover that it cripples your device, yet, you have no way to go back to an older version... That is called being forced. So it is the users responsibility now to just know exactly how an update will perform? We are all expected to be fortunetellers? It is fairly obvious that iOS 6 was the last iOS to perform adequately on all devices of the era. The ability to restore to that version SHOULD be an option for all.
All I'm saying is I don't think a court can force Apple to do this. And it's stupid to think that Apple intentionally cripples older devices. Why would they intentionally create a poor user experience for the customer? Doing so makes them much less likely to retain that customer in the future.
 
Ok, so you are now going to try to change the discussion to the issue doesn't affect many people now then?

I bet your sample size is completely irrelevant to make any counter claim.
Can you prove
1) that Apple knowingly slowed down everyone's devices
2) all claimed phones are slower
3) Apple knowingly advertises the opposite?

Didn't think so

So, the iOS 9 it's unlike any other iOS version that slows down the old devices badly.
Or it's really not.
 
I don't understand why people can even think about complaining that their iPhone or iPad has become slower after an update. Of course it does that, over time. Especially since iOS 7, everything has gotten more advanced than ever before. All-new design, a lot features.. That just costs some performance. You can't expect an old device to run all of that without a problem. Also, it's still your own choice. I've had an iPhone 4 running on iOS 7, and an iPhone 4s running on iOS 8 and 9. Did I complain? Hell no! Why? Because I realized that this old hardware isn't capable of running the many new features well enough.

It's a total difference story when speaking about the latest devices like the 6s (Plus) and 6 (Plus). If they would be unusable, I'd understand this. Maybe even with the 5s. But please, the 4s is now around 4,5 years old. Once iOS 10 is out, it will be 5 years. You should be happy for having so many updates for such a long time. When you go Android, you'd be in the update train for less than two years.

I'm sorry, but this case is as ridiculous as the many other cases in the U.S. these days. Heck, in the Netherlands they would laugh at you if you'd come up with this sort of cases. It's plain stupid, sorry.
 
Right because that would make for a great user experience. Why wouldn't a developer want their app to work with the latest OS?

Your trying to be hypocritical and twist the argument all the time, I see through you. So on the one hand you state who is forcing you to update, than on the other hand you state why should app developers not be forced by Apple to update their apps for a 'great user experience', which potentially means the app won't run on older iOS versions like iOS 6 that your sister runs, not all apps run on older iOS versions after being updated to support the latest version.

Which is it you support? Let me guess you'll claim that if you want to use apps you should buy a new Apple device?

It can, for like 7 days. But nor the means neither the time of signing are said ANYWHERE. Besides, that's not enough time for a daily basis test to conclude some decision, plus not knowing when the door is gonna close.

And what about restoring your device? Doesn't it force you?

Yeah, deal with it or not, but that really help on the "Forcing" claim.

But it is upon the plaintiff to prove that. It is really hard to prove any of these. I don't think the class action will go through at all, even if it go through the court, i don't think they will win. Apple has no responsibility to prove any of these.
 
This time they have a point and they should sue. Because now Apple force pushes the OS to your device, eating up multiple gigs of precious space, and doesn't offer any way to delete it. And once it's done downloading, it pesters you to update. Even if you say no, it's all "well I know you don't want to do it now, but we can do it at 4 AM while you're sleeping!!!"

So to the people saying "no one forced you to upgrade," well, yes they did.
 
Not with my 4 years old PC, still runs as smooth as it was even with Windows 10. Not with my 2011 Mac Mini with Windows 10. Not with my Nexus 5 with Android marshmallow. I can provide more if you like

And as I said my iPhone 4s ran perfectly on iOS 9. Let's swap more useless anecdotes that prove nothing!!

Personally I think their is a lot of evidence to support the claim, all Apple needs to do is stop supporting older devices with iOS updates. But they won't do that as it gives them an edge in marketing claiming 'look at how many products we will install the latest iOS version onto, way more than Android..' As consistently gloated about at their keynotes.
 
I think the case is ridiculous yet I still can sympathize. The main thing that gets me is Apple put this big emphasis into the adoption of Metal into the UI, and how iOS 9 will be faster, more stable, feature smoother animations, and have better battery life. I, personally, didn't see ANY of that on my iPhone 6. Everything has gotten much worse, battery life is still okay though. My iPad mini 2 didn't fair nearly as well, extremely choppy and sluggish after iOS 9, it was advertised as being smoother and quicker!!

Also I think it is total bull that if you are experiencing issues with your device and need to restore, you HAVE to get the newest version for your device. There is no choice. Same if you go to an Apple Store and your phone ends up getting wiped. No choice in OS version, no option to go back..! I don't sympathize as much with those who updated and found issues but more with those who had their device updated by someone else by mistake or it was serviced. And as I said, iOS 9 was touted as faster but it was the opposite. That's not okay.
 
How I see it

If you can't afford to buy a new iPhone (especially after 4 years)
then you should even own one in the first place...
 
What is with the people defending Apple releasing updates for older devices that make them run worse?

Apple is the one who built the device. They are the ones coding these updates to run on their older devices. If the update comes out running poorly that is 100% on Apple. It's not unreasonable to expect Apple to not make your device run poorly with new updates. If they can't make new features run well on older devices, don't put that feature in the update.
