Yes. They know they shouldn't drop their phone. Which is why they should man-up when they do - and not go crying to a lawyer like a petulant child.

These idiots are too cheap to buy a bumper, take out insurance and instead create a new job for a lawyer on a Monday that leaves him looking for something else to do on a Tuesday.

These people are drains on society we would be better off as a culture if most of them died in their sleep - or at least pursued a more productive and socially acceptable trade, like parking attendant or tax collector.

We need less leeches in our society.

I'm prrrrrrrrretty sure that you don't understand the purpose of a class action suit.

Does he think Apple has engineering some sort of magical glass that won't shatter? Apple says their glass is strong and scratch resistant, but some on, does he expect any phone's glass to not smash when dropped?

He's dropped his 3G more than once (similar heights, not similar height), his daughter's dropped her phone.

Maybe they should work on holding the phone so they don't drop it, or buy a case, because they seem pretty clumsy to me.

mine broke (not cracked, a piece of glass was missing broke) from hip height with the stupid free case a week after receiving the useless thing.

No. Not that.

This post sums it up quite well:
What ways would you suggest he attempt to get Apple to change their design to something more durable? The class action lawsuit is often used as a tool to get a company to change a practice.

I love my iPhone 4 but even I admit it was a dumb idea to make both the front AND the back out of glass. That was just asking for trouble.

You cannot make misleading claims all in the name of advertising. There are laws specifically protecting consumers from such things.

I'm not the letigous type so I wouldn't start a lawsuit like this guy did, but don't go trying to act like the iPhone 4 was a wise design. It was actually foolish to make something that is so portable out of glass on both the front and back. On the other hand, I do applaud Apple for doing the right thing and giving most people at least one free replacement. I think they knew they were wrong. Actually, this might burn them in the end as it will be proof they will use in the case to show that Apple realized it was an issue and a bad design to start.

Making a cell phone covered in glass was a bad idea jeans from the start.

Nope - I still think I got it right.

"Greedy fool tries to scam corporation".

If you want apple to change their design - buy an android.

Or buy a $5 case - don't try and dumb down the world.

We love apple products because they try and move forward don't we?

if its such a bad idea, don't buyt it.

Simple people, don't buy it no matter how enticing they make it. Obviously no glass in the world is immune to breakage even if it claims to have superior durability.

Going from something more durable to something less durable, and then using marketing tactics to make it seem better, is not moving forward.

Apple isn't perfect. In their frantic desire to make a phone that is as thin as a piece of paper, they decided to use glass in a device that people tend to drop. If that glass was, say, an inch thick, it really would be as durable as a helicopter's windshield. But at 1mm in thickness, it just isn't.

Don't get me wrong, I love my iP4, but right when they announced that it had a glass back, I was like: "What are they thinking?".

Exactly - it's obvious the thinness will come at a price.

That is why you get a case or insurance.

This guy is an idiot trying to cheat his way out the consequence of his stupidity - and expecting you and I to pay for it in higher prices and a dumbed down future.

You smash your car you don't usually sue the car company, you drop your phone you drop your phone. If it breaks well you dropped it!

If your kid was using it and dropped it more fool you!

Think what you want, but it's lawsuits like these that will cause Apple to rethink the iPhone's future design.

A glass covered iPhone isn't practical for daily use by the average user. And BTW, the average user isn't one of these OCD iPhone fanboys that has a case for their case.

This isn't a step forward: https://www.macrumors.com/2010/10/12/iphone-4-more-prone-to-accidental-damage-than-3gs/

I've dropped my iPhone 4 from a number of heights accidentally. Sometimes over a metre onto a very hard surface. And theres still no damage to it. Ok, a few scratches if you hold it under a quite bright light. But nothing that you'd ever see. It still looks pretty shiny, way more than my 3G did.

There might be some truth to this? But I doubt it.

Great, we'll all get $1.25 and some lawyer will get $100,000.... what a great waste of time, energy and money. I've dropped my IP4 a couple of times, no breakage.

To each their own. I've dropped mine exactly once, and the glass broke. Luckily it's in the bottom left corner and not in the viewable area of the screen.

Wow.... I dropped my iPhone, 4 times (hahahah

) and it's been O.K every time. I'm not sure how people get money in these sorts of things...

"think what you want, but it's lawsuits like these that will cause Apple to rethink the iPhone's future design."

We agree - stupid cases like this will slow the future down as firms have to dumb down designs so £500 phones can be dropped by children.

Like that future?
show me any smartphone that bounces every time at 3 foot.

Want all progress to be retarded?

"A glass covered iPhone isn't practical for daily use by the average user. And BTW, the average user isn't one of these OCD iPhone fanboys that has a case for their case."

You said it yourself - a glass phone was always going to be a risk.

You don't take insurance or spend a fiver on some sort of case before you hand it to a child?

Why should we all have to pay for such stupidity?

Every material has a pressure point. And if the glass really is made from the same on windshields of helicopters and high speed trains then the way the glass is formed on windshields is suited for 300 MPH debris. However, the glass on the iPhone is not the same because it has a different size and shape. When dropped on its back or face it can survive but when dropped on its side or on an angle it shatters. It's just a fact of life. Glass shatters. But that doesn't mean you have to sue for $100,000.

But basically, don't drop it!

And if you ask me, this guy's just lookin to get rich off of lying. Good luck livin a lie.

I'm not a fan of the glass. That move went too far with style over function. I'm hoping they have a new design for the iphone5.

Sorry, I forgot.

It's a big company that is being leeches off, so that's ok.

Oh hang on, I buy their products, so they will get more expensive to pay off this wingnut if he wins or loses because apple will have to pay it's lawyers to fight this dumb case either way.

Not to mention the fact that we will all pay when companies have to make sure their £500 phones are childproof. None if the iPhones so far can be safely dropped 3 foot reliably.

We all pay when adult gadgets have to be dumbed down.

Where is Judge Judy?
"Don't give a child a glass phone and expect a handout when she breaks it. Next!

A contributing problem is the way Apple words their ads.

Calling it "ultradurable" and "harder than plastic", would certainly make many people think it's practically indestructible. After all, their "just plain durable" plastic phones bounce off the ground all the time :)

It's also misleading to bring up helicopter and high-speed train glass as being made of the same type of material. Both of those uses are much thicker than the iPhone version, with the train windshield especially often being one to three inches thick (!!)

Typical assumption and response. Create a diversion to remove any responsibility from Apple. Then make a ridiculous suggestion.

What about the responsibility of the consumer?

"Don't buy products from a company you don't like" is apparently a ridiculous suggestion. I am sorry for suggesting such a ridiculous approach to consumerism.

What about the responsibility of the consumer?

Considering the company has much greater resources available at it's fingertips, a company's responsibility will always be greater. With great power comes great responsibility.

Without some sort of consumer protections, companies have the ability to lie to the consumer and take great advantage of us because we simply don't have the same access to resources as they do.

At no time did I suggest I didn't like Apple. You assumed that ever so erroneously.

I'm simply pointing out how Apple's actions setup unreasonable expectations.

Why not point out the quality materials used, without making such unreasonable claims about their durability. Apple is a highly intelligent company that could have highlighted the quality, but reminded consumers that all glass is subject to breakage. In today's market, stating the obvious makes a lot of sense.

I've had my iPhone 4 since the first day they shipped. I find it very durable and quite stylish. It looks as nice as the day I unpacked it.
