What a Klutz this guy (or his daughter) is.

I wonder if this guy routinely spends a couple hundred dollars on things that he then throws to the ground. I suspect he'd not telling the whole truth about "how" the phone got dropped. I know a few people who have accidentally dropped their phone with nothing happening so his claim is a little suspicious, especially when his claim states that he also dropped his 3GS and nothing happened to it. Why doesn't he just quit pissing and moaning and go get a 3GS. I'm sick of people who have a propensity to initiate frivolous lawsuits.

If someone sees this as a problem they shouldn't buy a phone with fronts and backs made of glass. People are all too willing to blame their problems and choices on other people, but nobody wants to accept accountability themselves.
 
In apples defense it doesn't say its tougher.

That being said it does seem iphone 4s break easier and are harder to repair when the front glass breaks compared to 3g/3gs

Actually, it is much, much easier to replace on iPhone4 then any previous version.
 
I saw that coming...

I dropped mine a couple of times but luckily it always had the bumper on it.
I know it is not as stylish with the bumper but it was an expensive gadget and the bumper protects it a lot.

Bottom line every smart phone will break if you drop it in an "unfortunate" angle... Right?

The guy who is suing has been hanging around to many lawyers...I have dropped my phone many times and have been surprised that it hasn't broken. He needs a job to keep him busy, maybe he needs a tether to keep it in his hands…
 
What Apple should have done differently

Our iPhone 4's front face shattered the day after I bought it, when my 8-year-old dropped it from a similar height (3 feet).

Is the 4 slipperier than the 3Gs? Yes.

Is it, because of the glass-glass sandwich, easier to shatter? Absolutely. (My son also broke one of those, but it took multiple attempts). :D

Is this design flaw, if that's what it is, lawsuit-worthy? Well, I wouldn't sue, but there is one very important thing Apple should have done differently, and probably wishes it had:

They should have given us a case or at least a rubber bumper for the "death grip antenna issue" at point of sale.

Because we knew we were getting a free case, we waited for Apple to send it (it took 3 weeks) instead of buying one to protect the phone right off the bat. I wonder how many other people had the same "window of opportunity" to break this quite fragile (for a mobile device) phone? Apple could have saved itself and its customers a lot of anguish by selling the phone with a protective case and a sticker advising customers that glass is breakable. Some of us still have a hard time figuring that out. :)
 
I could just picture the kid throwing a tantrum and slamming the phone into the ground as hard as she could... at least that's what i'd do if I were that young and given an iphone, but then again... I was an awful child;)

But yeah, apple already gave us free cases with them? Mine has helped on a few corner falls rather well...

My only complaint is how fingerprinty the glass gets.. but ya know...
 
I shattered both glass plates, but don't agree with this lawsuit. I've dropped my replacement phone numerous times without damaging the phone at all. The only reason the first phone broke was because it fell out of my cycling jersey at 40mph and slammed into a rocky ditch. Furthermore, Apple sold me the replacement at an unsubsidized $200, which I believe is below cost.

Yeah..... restrospectively thinking it after his daughter droped and broke his phone. Caveat emptor...... buyer beware; think about these things before you buy stuff. Or, at the very least, ackowledge that you have a phone with glass on both sides and take the proper precautions.
 
Amazing. Drop a phone with a display made of glass, glass breaks, sue Apple. What an idiot. Hope the judge throws it out and makes the plaintiff pay for any subsequent lawyer bills.
 
So basically, we have dumbasses who bought a phone surrounded by GLASS, were careless in their handling of it, broke said glass, and now blame Apple? Makes perfect sense to me.

I don't care what Apple claimed - it was still GLASS, dummies.

IT DOESN'T MATTER WHAT APPLE SAYS. Don't drop your phone, and there won't be a problem.

I've owned every iPhone generation, and I've NEVER DROPPED MINE EVEN ONCE.

I immediately expect everyone else to treat the phone the same way. If they don't, then they pay for that.

I agree with him. The marketing is grossly misleading. The iPhone 4 is far more fragile than previous iPhones though it's advertized as being significantly less fragile.

He seeks to have everyone who had to pay apple $200 to get the glass replaced, reimbursed. I think that's a great goal.

I also think this suit if it succeeds would greatly increase the chance that the next iPhone will use actual Gorilla Glass so that it remains damn near indestructable. At the very least, they should stop marketing it as being so damn unbreakable.
 
You gotta admit that using glass to make something that often gets dropped...is not a stroke of genius.
 
Sorry to say but...

...I would definitely support this lawsuit. I also dropped mine about 3 ft off the ground as well.. completely shattered the front glass after owning it for 2 months. (Apple gave me a 20% discount on the replacement, but it still cost me $172 to replace) I had an 1st gen iPhone that lasted me more than 2 years without problems. I love the aesthetics of the iPhone 4, but the glass almost always takes the impact no matter how its dropped.. looks good, but bad idea.

Correct me of I'm wrong, but doesn't glass break when dropped, often regardless of height? I've dropped my iPhone several times from chest pocket height on to tile flooring, no damage...
 
Well

My iphone 4 cracked as well. It was probably a little less than 3ft. It slid out my pocket will exiting my car. Funny thing about it is I had the "recommended" cases from the iphone case program. I hope the lawsuit is successful. Had I known a case cant prevent a cracked screen I would have purchased an android phone.

This is where America needs to fix the system... pure $'s driving this one.
