no, but maybe he thinks apple shouldnt make an iphone whose front and back are made of glass? which makes total sense.
Then he didn't have to buy it. He could have simply said to himself, "this seems too fragile for the way I use my phones. Maybe I better not buy one made of glass."

The plastic back of an old phone broke when I dropped it. Better sue Samsung!
 
So many problems with this...not the least of which is an individual doesn't file a class action lawsuit. A judge may determine that later but right now it's him against Apple...and I'm betting on Apple. :rolleyes:
 
It's not like people choose to drop their iPhone.

Yeah but a lot of ppl are idiots and not careful expecting it to be indestructible. And as far as durability, the last phone I've seen break was a crappy flip open keyboard Verizon plastic thing...my friend dropped it like a few feet onto a thick carpeted surface. It's not like the phone is flimsy, what happened to people being responsible for their belongings? This guy is a clown, learn how to be careful. End of story.
 
I don't agree that this should be a lawsuit- it is a waste of everyone's time and furthers the damage of our already too-litigious society.

But, I do agree that the ad is misleading. They clearly state that they are using the same glass as used in high-speed trains and helicopters and yet the phone is far more fragile than the glass used in either of those- there is clearly a disconnect.

Fine- you guys who say don't buy a glass phone if you want durable are right, but, apple shouldn't have made a big deal about it being special, super-strong glass then.
 
What design flaw?

This case will be dismissed very quickly. The plaintiff was negligent when he handed his daughter his iPhone and she dropped it.

If the iPhone glass breaks with little force(like with just a simple tap), I can see a case here. Since this guy put himself in a situation where his iphone could break, he is responsible.

I am no lawyer.

Hope people realize the key word in this phrasing is "chemically".

By the way, I have seen helo and plane windshields cracked and/or broken from bird strikes. Wonder if the pilots sued Boeing?

However, this lawsuit has no basis for continuance and any lawyer fees incurred from Apple should be charged to this man.

All I know is that if I were to drop a 3GS and an iPhone 4 from the same height, there is no chance that the back of the 3GS will crack. There is a good chance that the back of the iPhone 4 will crack. How does that make the glass 20x stiffer and 30x harder than plastic?


Think about this one: The Diamond is one of the hardest things on the planet, right? It is used to cut rock such as granite or marble like a hot knife through butter (while most metals can't do anything.

But guess what? If you hit the diamond...just...right...it shatters!!!

The point is that the softness and flexibility plastic provides as compared to glass is better for impact protection.

If you drop glass it will break.

It was never claimed to be unbreakable, only more durable. If it was dropped the right way, it is going to break.
 
Oh sure

in America you can file a class action lawsuit for people dropping and breaking their phones - but if your mortgage company re-writes your mortgage or changes terms without your knowledge and puts in an arbitration clause; no one can file a class action against them due to the "having to go through arbitration". Even if they are practicing misleading, rude, and could be construed fraudulent tactics. I know I looked up how many times someone tried to file a class action.

No wonder our economy is in such a mess, jobs are lost, and people are scared about hiring people or going into business for themselves. the tax laws, risks, etc are confusing enough never mind restricting. thus why it is easier to outsource overseas with little to no tax code, and no standards.

I am all for having laws to ensure we have good products, standards, etc. But where does the foolishness stop.

oops - my laptop just fell and broke due to my walmart desk collapsing. Better file a suit against walmart for selling the desk, the manufacturer of the desk, and Apple for making a product that could not withstand a fall. :rolleyes:

Look, sometimes, no matter how careful you are, things get dropped.

I'm extremely careful with everything, but I dropped my 1st gen iPhone on a sidewalk once. Fortunately, the only damage was a little gouge out of the aluminum on a corner...the screen didn't break. I have a feeling that if it was my iP4, the front and/or back would have shattered.

This guys a serious thinker isnt he.

There are iphone cases to further protect the phone. Anyone worried about breaking their phone would show wisdom and nimble thought to get a case.

Either he isnt revealing the whole story, or his unit was defective. I mean how many times do you have to drop a phone till you realize that your a klutz and need a case.
 
I dropped last night my beer glass and it broke - can I now sue the manufacture of the glass for producing such a horrible breakable product? Or should I go after the beer company for producing something that makes me drunk? Or I could sue the manufacture of the tiles in my kitchen, after all they made the glass break! Hmmm, choices, choices ...
 
I do believe sometimes Apple's descriptions are a bit lofty, or even untrue in general.

When the unibody white Macbook was released in 2009, I read this description (which is still on the Macbook's webpage: http://www.apple.com/macbook/features.html ) "And the display is greener than ever: power efficient, free of harmful toxins such as mercury, and made of arsenic-free GLASS." Everyone knows that the Macbook's display is NOT made of glass, but rather, plastic. The edge-to-edge glass was one of the reasons I went Pro.

Also, if you go to this page http://www.apple.com/macbook/ and click on the 360 view, you will clearly see the Macbook is pictured WITH edge-to-edge glass. You can see the reflections around the bezel.

Anyway, I contacted Apple and the representative didn't even know if the screen was glass or plastic. After 20 minutes of being on hold, the representative returned to inform me that the display was not glass, but plastic. I asked why it was advertised as glass and the answer was "I don't know".

Apple needs to watch itself with descriptions.

ME TOO! In fact all my cellphones I have ever owned I expected to break when I dropped it. I had an Nextel with hard plastic around it and I once dropped it and it got a thin hairline crack on the inside screen.

When you see the lawsuit is in CA that is all you need to know.

They said or advertise is the same type of glass, not that IS the same and share the same thickness or other properties. The for your question about how is 20 to 30x stiffer than plastic... Have you ever saw the thickness of the back or front glass on the iPhone? Ok, then try to imagine a plastic that do the same, specially concerning thickness. Composite materials like carbon fiber could do the trick, but can you see thru them? (front glass)

His kid was playing with his phone? Yeah, right there pal. Give a $500-600 device to a kid and sue when the brat breaks it. I'm wondering how old the daughter is. I bet she's 4 or 5.

Correl dishes are "shatter proof." I think everyone had them in the house at some time in life. You can drop the dishes onto a tile floor and they usually don't break. But when they do, it's glass... kind of have to expect that or we'd build everything out of that material.

This guy is a (insert favorite expletive here). I've dropped my phone from a good distance on hard surfaces and no cracks or breakage, but I'm educated and not a moron. I also know I could drop my phone six inches onto my desk and break it and it not happen from 3 feet. The angle it hits, the speed it falls, what it impacts with... all make a difference. There are people that fall 15 stories and don't break a bone, and someone that trips on a rug and dies. Miracle? They just landed in a way that is that far end of the odds spectrum. Just because you have a phone that shouldn't break, doesn't mean you throw it off a building to find out.
 
my phone fell down from 2 feet and the glass broke in a 1K pieces. I went to the Apple $tore and I had to pay $200 for a replacement phone. it sucks. Still I do not get why I have to return my broken phone and pay $200 on top, I think this is a scam, since that they make twice the money, replacing the screen and resell it.
btw, at the store there were tons of people with the same problem, we all had to pay, they do not give a .... the official scuse that they repeat as a mantra is : it is glass, it breaks easy. My iphone was inside an official sleeve when it fell. If it is so delicate, it is scary, putting a piece of so fragile glass so close to your intimate parts in the front pocket of my jeans. If the jeans are too thigh it may break and cause you serious damage, think about it for a second, you apple fanboy... would you put a champagne glass in your front pocket of your pans?

Nope. So if you think that the iPhone is so dangerous to your junk, why did you do that?

And why in god's name are you wearing jeans so tight that they can crack an iPhone?
 
Hmm where on that advert does it say - glass is unbreakable ( which is what essentially what he is claiming) amazing his lawyer doesn't just be honest and say the guy will be laughed out of court.
 
So assuming the daughter was standing when she dropped the iPhone three feet to the ground, she's either a child or a short person.

The guy probably dropped the iPhone himself and blames it on his daughter. He probably dropped it a good couple of times too, before it finally broke.

Weren't there videos of people testing iPhone 4's durability? I think it lasted 3 drops.

I dropped mine 4 times so far, but I use a case.
 
I got news for you. Europe is equal to or worse than the U.S. with b.s. litigation. Don't think for a second that this is just a U.S. problem.

Maybe in the UK as the legal system there is similar to the US. In most European countries this kind of issues are intermediated by consumer ombudsman type of organizations. If fact this very issue has been in the news in the Nordic countries, at least in Norway and Finland. Turned out that the glass structure is vulnerable for temperature changes as well. Some of the consumer ombudsman have already issued a statement that consumers have right to return the device or get compensation.
