If Samsung innovated in the first place, there would be no infringement. The whole point of this case is to force innovation without slavishly copying others.

Well at least we are one step closer to closing the chapter. I assume Samsung will play out its last two options. First they will appeal to the Supreme Court, which I expect not to even hear the case, but that will cause at least 6 months to a year delay. Then when that fails they will try to delay the payment or try to negotiate some type of payment plan. My guess is we still have 18 months to 2 years of life left in this, but then we will finally see an end to the lawyers and we can move on to something else. Finally.

That korean copycat company has a long history of theft of others IP. They've turned it into an art form. Pioneer, Sharp, Sony, Kodak, Dyson, Apple, Motorola, Microsoft, Fisher Paycal, and on and on and on the list goes. When they are sued, they countersue on minor infringements, then when they lose, they appeal, appeal, appeal, all the while they keep making billions from stolen IP. This blatant criminal business practice will kill off innovation, kill off competition and kill localised manufacturing, and everything will be made in korea. Only a mindless fool would cheer this criminal organisation on, and most of them come here and haunt this site.

So your talking about who here? Because Apple is currently stealing from Ericsson and making billions so it gets confusing as to which criminal organisation you're referring to...

yeah, some overly harsh (violent?) words in a few comments, but in general, the truth is being spoken. this charade is Samsung's M.O. as far as electronics are concerned.

haven't been keeping up with their fridges, washers, and microwaves (lol), but i wouldn't be surprised if they just steal and pay lawsuit fees while they corner the market in those categories either. could be wrong, but ducks look and quack like ducks, innit?

On the flip side - Every organization - even Apple does whatever they can to avoid paying out anything for a lawsuit. This is business as usual. Appeals, Appeals, Appeals.

Did Apple just throw their hands up when they were accused of collusion?

Samsung watch is round as a watch should be, Apple watch is square, don't see any copying here, if anything Apple copied the original Gear watch, both are squarish

Apple throws all the round icons onto the screen into a mess, Samsung has icons that cleanly encompass the edge of the screen and are all the same size

really? the old samsung gear looks like a samsung offering. then apple made a very Apple-y watch. then, like always, every time apple releases something, samsung tries to cash in on it immediately - colors, build, overall aesthetic.. usually accompanied by very similar Apple-y marketing/packaging/advertising, etc...

that round watch is indeed and undoubtedly round. but it looks like it belongs in an Apple Store. Apple Watch Jr? Apple Watch Kids Edition? come on...

Samsung having a rough time at the moment. Falling sales, falling profits, falling marketshare, the fail that was yesterday's Note announcement, the failed iPhone copy that is the Galaxy S6...

IMO the copycat company deserves all they get. I hope they crash and burn and someone more deserving of the top spot takes their place.

Galaxy S6 isn’t inspired from iphone, but from Ativ S which is a phone made by Samsung.

as far as i've been told/ reported to, apple tends to do this, yes - but more in line with American laws. and a lot of the details mentioned (take for instance xerox), have often overlooked, ignored, or purposely damning FABRICATED pertinent details regarding the story.

look, you can force people to defend apple and call them out on it because apple isn't perfect - but the point is that Samsung - skirting American laws and being shady Korean con artists in certain departments of their vast Operational Empire - is much less commendable. in a lot of people's eyes, anyway. including hundreds of large American companies who have been filing similar 'holy crap, how dare you?' kinds of claims against them for decades. largely in electronics.

No it won't. It will make Samsung (and others) think twice about just copying Apple (again) with the upside that they'll be more innovative because they'll have to think of something new.

Modern corporations really don't want to have to obey the laws. That does work well with our modern administration which also believes corporations should have not to obey the laws, if they make enough campaign donations.

I can see Google, Facebook, etc, saying, why O why can't we get the same deals the banks got and actually get paid to break the laws.
 
The argument made by Facebook, Google, and others is that the aspects of Samsung's products that infringed on Apple's patents is only a small part of the value of Samsung's profits and it's unreasonable to set a judgement as if all the value came from Samsung's profits. And when Apple has been sued, it's made this argument.

The thing is, of course, that the judgement is not all of the profit (to say nothing of the revenue) of the projects. One could argue that the portion is too large, but that's a judgement of fact that is the jury's job.

Samsung had the opportunity to pay a licensing fee that would have been proportional to the value of the small infringed part relative to the whole device. They could have done that as an arms-length negotiation before infringing. They probably could have even come close to it during settlement negotiations. Instead they chose to infringe, and they chose to fight the damages. They lost. Now they have to pay lost profits. Some aspect of this fine, even if only a little part of it (ironic, ain't it?), is to deter similar decisions in the future.

that's so sad it's funny.
because alot of these infringements are basic foundations that makes smartphones what they are. lets say these infringements are like colors and paint brush, without some of these colors and paint brush it would be very difficult for you to make the painting you want.

So it doesn't look like something Apple's actually selling, but it looks like something Apple could sell... BURN SAMSUNG TO THE GROUND! where's that torch and pitchfork emoji?

Um, isn't the concept of innovation NOT to copy things?

Not completely wrong but also not completely right. A certain amount of copying within a market is needed to push a company to innovate. There would be no progress if everyone would focus on different markets and products. That's why these empty comments about Google and Samsung needing to disappear (they are in every thread) make no sense. Apple needs to have them around to be pushed to deliver better products and the other way around.

Wow the way you describe those icons makes it seem like you're somehow deeply invested in Samsung. I mean seriously... they cleanly encompass the edge? Think about it, they can only show about 10 icons at a time while you can easily find all of your icons on the apple watch on one page that you can organize as you want.

Anyway, like others have said, the roundness appears to be the only major difference with the overall feel and look resembling the apple watch more and more.
