I dont need the story to tell me they are thieves. They posted pictures and information about an unreleased iPhone prototype on the web. Nobody can deny that. There is absolutely any way that they were given that phone by a legitimate source with proper permission of the owners (Apple). They are thieves and their lives should be completely destroyed as they are made examples of.
 
As a consumer, I'm happy that the new iPhone was leaked. This steps up the competition on Apple and other smartphones.

So therefore Apple deserves justice more than anyone else? Call me crazy, but I don't think that's what the authors of our constitution had in mind.

Apple already got their phone back - calling out the high-tech multi-jurisdictional task-force was simply overkill. If it was still "in the wild", MAYBE I could see this, but even still, it's a little ridiculous.

And Apple doesn't exactly have a 100% success rate in the last 10 years...

Yes, we have limited law enforcement resources. They should be allocated to those crimes that impact our society/economy the most.

So what you're really saying is that you want Apple to suffer maximum damage? You -do- realize that this will be the outcome, right?

Apple thrives on an image as a cool company, but after this, they will look about as cool as Metallica post-Napster. In case you haven't noticed the pattern, the general public always roots for the underdog, not the party that happens to have the law on its side (that's largely irrelevant in David vs. Goliath scenarios), especially if that party is a big corporation. Jason Chen will achieve Robin Hood status and Apple will be remembered as nazis. Sounds pretty much like the opposite of what you want.

With all due respect (since you seem sensible)... fear of the consequences is sometimes the only thing left to restrain that small fringe who seem to lack a conscience and empathy and cannot acknowledge that it's wrong to steal from, harm, and defame others.

Secondly, a guy finds something laying around in a bar, asks a few people if it was their's, and then leaves with it. And he's getting charged with a criminal act? That's not quite as ridiculous as the still employed engineer, but close.

Apple had an irresponsible employee, and now they've lost their advantage in the secrecy game for the new iPhone. That's just the way it goes, so leave the police and the attorneys out of it. The way they are acting, this so called poor engineer was leaving the bar after a few cokes and cheese crackers and was held up in the local bathroom while taking a squirt before going back to work. Unreal.

Uh... read any website with reader comments about this whole fiasco and you will see that people overwhelmingly side with Apple on this.

No, it isn't.

Mind you, it's not as clear cut as a second story man, but the information out there doesn't paint him as a particularly ethical or law abiding citizen.

What were they unsuccessful with?
 
It was stealing - or something similiar

Even if the "finder" did call Apple it is not enough: He knows it's not his phone. (ok, actually he knows prob. exactly which phone it is) Either leave it then at the bar or give it to Police or something equivalent.

Giz or Chen did also several "illegal" steps: Buying a phone that they know is in all probability not belonging to the seller, and later showing pictures of - as far as they know (they write it so as well) - a prototype although they have to know that the owner (eng. or Apple) doesn't want to let pictures of the prototype made public.

If the eng. lost or mislaid the phone cannot play any difference - at least in my opinion.
