True, but one is health and the other is a phone. That's why the former is held to higher legal standards, and people are right to demand that they be enforced.

The simple answer here is that if people don't want to complain later about Apple not fixing or replacing their phone, don't get it drenched just for fun. Expecting it to survive accidents or some rain is one thing, showering or swimming with it every day is something else. Water resistant is not water imperious. People need to stop expecting to be protected from their own wreakless actions and then blaming others when they're not.
