If he wants the old HDD so bad can't you ask him to send you the "broken" one and you will send him the one that originally came in the MBP so everything will be covered under AC. If he doesn't want to do this and wants you to send the old HDD while he still keeps the new one then you can pretty much guarantee he's trying to dupe you. You could then just replace the "broken" one and keep it or even resell it for more $$. Just a thought.
 
The time and effort this buyer spent anoying you with his lies is ridiculous. He should get a replacement for the broken drive and install it. It's still under warranty and replacing a drive is very easy. In fact, you promised waranty until may 2011 and we are august so he gets a better deal than promised.
 
Bottom line is, a lie by omission is still a lie.

I am not going to argue - the buyer is a huge pain in the butt and it seems like you've been trying to be helpful. But saying you were upfront in the ad is inaccurate. If I bought an Apple computer from someone and they didn't mention any alterations in the ad, why would I think there would be any? I just hate when people use the excuse you're using. If someone was selling an iphone and said "Works great!" and then it turns out the screen is cracked, but it works great... should the buyer have specifically asked if the screen was cracked??? It's up to the seller to give the details.

Good luck. I doubt he'll be successful with a charge back, but it seems like he's not going to leave you alone.

Personally, while the buyer might be a total dick, I don't think the seller too can come out of this smelling of roses.

OP, while your ad does not specifically say your harddrive does not come from Apple, do take note that Apple does have 500GB hard drive offerings listed in their store too. you have to explicitly state that yours does not come with the stock option or it will be implied and assumed that you are offering genuine Apple provided parts. It may have been a fallacy of the buyer to not check with you, nevertheless, there may be recourse from the buyer because you offered a product similar to what Apple offers and unintentionally sold it off as genuine.

My take on this. Its your mistake, so just send the stock drive to him, because if the buyer is aggressive, regardless of chargeback, or Paypal, etc... there will be a chance he will get his money back. It makes good sense to rectify your own problem, even if it means a loss to you. Lying may not be a good thing to do on the art of the buyer, but he had every reason to seek reprieve from you because you made the mistake.
