Nightmare is much of an hyperbole. The idea that going to multiple restaurants, multiple boutiques, different supermarkets, multiple companies, multiple people, is worst than going one place, one person, is a misconstruction of reality. We all do that on our daily lives and its demonstrably a good way to go about doing commerce.

Using one POS for everything It may look convenient for an awhile until it becomes bigger then everything else ... and starts biting. Its like everyone using the same uniform, if you are wearing one your not the commander... convenient yet ...

Now, someone pointed out, it would good to have an human automatic inventory of all the apps and services installed and subscribed ragardless of distributions channel ... I suppose OS could facilitate that ... say an App Wallet ...
Honestly, hyperbole is all this complaining about a company simply charging a fee for use of its IP.

You are complaining about the way you see things and I'm complaining about the way I see things. Your description of your perfect world sounds worse to me than the current world, so it is simply down to viewpoints. I'm just expressing my viewpoint as you are yours. I'm just trying to make you aware that your utopia is not everyone's. I would like to point out that far too many freedom fighters end up as tyrants imposing their view of freedom because they are so sure their view is the only one. The world is rather grey instead of black and white.

If someone came along and offered an OS with the features Apple provides I would buy it. And I did. And I am happy with it. I'm not looking forward to the potential of not liking it as much because some people bought it despite NOT liking its features and want it changed to match something they didn't buy. That is my worry. And if it gets to that, it isn't like I have an alternative to switch to regain the features I like.

But this is all simply arguing theory on the internet which is entertaining, but pointless.

Since it sounds like you know what you're talking about, I think my terminology was just wrong. They aren't suing for discovery, it's that discovery is just part of what will happen if the suit goes forward, right?

Exactly, although discovery may occur in stages, it should be largely a liberal application of what is relevant or likely to lead to relevant evidence.

Surely getting the trial to discovery requires that they have some evidence for their suit even in the US???

You’re right with what I think you mean: to survive beyond discovery, that is until the trial, a lawsuit will need to have some facts that a reasonable jury could find in the plaintiffs favor which if true, could lead to a verdict in their favor.

Otherwise, without more information, you are also correct, after discovery a motion to dismiss would probably be granted and it would not make it to trial.

Whether or not it’s frivolous or without merit, that’s a different story and probably not worth the fight.
