That depends on where you are.

However, it's never morally ok to keep it. Follow the Golden Rule, people. At least make an effort to be a good human.

agreed, i wonder of the people that say "keep it" and "finders keepers", what iaf you lost something and that person tried to return it would you tell them, "dont worry you keep it, you found it so its yours now"

ha, a $20 bill is far different than a cell phone that can easily be tracked back to the owner by taking it into a store or probably even dialing 611.

I opened this thread expecting to read a post asking how they can track the owner of the phone. People suck. I hope it explodes in your hands :apple:

Hope the OP was genuine in his post stating to give it back. I honestly found the posts advocating he should keep it quite shocking. Why the disregard for the person who lost it?

I've never lost my iPhone but I hope that if I did there would be someone who found it willing to track me down. Or at least willing to turn it in to lost & found.

Legally its yours.

(...)

Anyways, i would just keep it. Not like you did anything to create that situation that you are in.

Not at all true or well advised. These are the arguments of someone who's trying to justify what they already want to do. If you found a car that was unattended, even if you could reasonably determine that it ended up wherever it did against the will of the owner (e.g. lost, stolen or otherwise inadvertently abandoned), would you also think you could legally just assume ownership of it? Under the law, why would that be different? The fact is that finding unattended property does not mean it's legally up for grabs, and that is a fact. We should all know that Apple famously pursued this with the lost iPhone 4 prototype.

Seriously, what would you want someone to do if it was yours and you lost it?

I have IGotYa installed. I'll hunt the ''finder'' down.

I am realistic, i dont expect anyone to return it.

This isn't the school yard where finders keepers may apply.

Are you a lawyer? You shouldn't be making legal decisions for others if you aren't.

Lost property isn't yours just because you found it. Ask your local police department, they'd be delighted to enlighten you.

Do the right thing and return it.

If you did everything possible in order to return it and failed, yes legally its yours.

Since it had a passcode and he was unable to acces data, yes he did everything.

Its reasonable to say that he did what he could.
